Today, 8th September 2006, Gilbert Thiel, Examining Magistrate of the Anti-terrorism Sector of Paris First Instance Tribunal, convened Giuseppe Maj and Giuseppe Czeppel, (new)PCI members, and Ramon Teijelo e Manuela Galan, members of the (PCE(r)) Fraction Octubre, to communicate them what he has decided.
At last, the Judge G. Thiel officially admitted what comrades G.Maj and G.Czeppel are declaring since June 2003: they're not involved in preparing terrorist actions. Judge G.Thiel will send them on trial, charged with "simple" wrongdoer association, instead of wrongdoer association finalized to prepare terrorist actions.
Unfortunately, this decision comes only after Judge G. Thiel tormented the comrades with 18 months of preventive detention and 21 months of probation for G.Maj and G.Czeppel, with 4 months of preventive detention and 10 months of probation for A.D'Arcangeli, with 11 months of preventive detention for Ramon Teijelo and 4 months of preventive detention and 7 months of probation for Manuela Galan.
The new "simple" wrongdoer association should include G.Maj, G.Czeppel, A.D'Arcangeli, R.Teijelo, M.Galan. At present, which social target these five united wrongdoers want to get is a mystery.
Judge G. Thiel's conclusion is the same of the Attorney. This conclusion confirms that only the collaboration between French and Italian Authorities explains the French Authorities' rabidity against (n)PCI members and collaborators for more than three years.
The decision Judge Thiel communicate today follows the fact that Italian Authorities, trough Paolo Giovagnoli, Attorney of Bologna, get ready their 8th proceedings against the (n)PCI caravan. Now the Italian Authorities don't need anymore the services of the French ones. So, the judge G.Thiel from Paris give the commission to Giovagnoli (Bologna).
Now, we wonder why:
1. Judge G.Thiel keeps the competence of the case, even if he admitted the affaire has nothing to do with terrorism and G.Maj e G.Czeppel made a petition of not competence to which judge G. Thiel never answered;
2. Judge G.Thiel continues to deprive G.Maj, G.Czeppel, A.D'Arcangeli and M.Galan of their freedom, keeping them in probation (the Spanish Authorities issued an European warrant of arrest against R.Teijelo, to which the French Authorities will answer affirmatively),
3. Judge G.Thiel particularly continues to deprive G.Czeppel (and only him) of his identity documents.
This very day, G.Maj, G.Czeppel and A.D'Arcangeli asked their lawyers to urgently lodge:
1. a petition asking to immediately remove all freedom limitations;
2. a petition asking Judge G. Thiel to give back to G. Czeppel his identity documents;
3. a denunciation to competent authorities against Judge G.Thiel for abuse of power, because he continues to limit the freedom of investigated people and to
deprive G. Czeppel of his documents.
The Paris CAP asks all democratic people and all comrades, personalities and committees to write an open letter to Judge Gilbert Thiel (Tribunal de Grande Instance 4, bd du Palais 75001 Paris, tel.0033.144326351 fax. 0033.144325757), expressing their opposition to (n)PCI's persecution and his abuse of power.
