The Alabama D.O.C. is designed to house fourteen thousand inmates and is now pushing twenty seven thousand inmates. The Alabama board of pardons and paroles refuse to follow due process. My parole date was set for July 1st, 2001, I later received a postponed date of June, 4th, 2002, 11 months after my set date with out any form of notification during an 8 month wait of not knowing when my actual parole date was going to be held. On June 4th, 2002 I was rescheduled for November 19th, 2002, without any reason why, and on November 19th, 2002 I was rescheduled again for February 11th,2003 and rescheduled again for April 8th, 2003 and on April 8th 2003, I was rescheduled again and as of May 9th, 2003 I have not received another parole date.
I have 14 years of incarnation built on a 20 year sentence of a first degree assault conviction with two theft convictions running concurrent 2 years-1year with the assault sentence of 20 years. I have been up for parole consideration 3 times and been denied. At this point I am approximately 5 years from my last parole consideration date with two years of postponements on top of the 3 year set off, and to put the icing on the cake of parole consideration I've not had a disciplinary since May 20th, 1994 A 9 year disciplinary clean institutional record.

CR.App.1995 I was a 17 year old juvenile that was in a heat of passion conflict with a 21 year old man over a 15 year old female girlfriend of mine. Over a period of time the conflicting situation escalated to the point of where I shot him in the shoulder with a .25 caliber pistol. The victim was released from the hospital and he went on a drinking and drug binge for a month period and was later found bleeding. He was rushed med-flight to a hospital where surgery was performed and the injured artery in his shoulder-That I damaged was finally successfully repaired. Approximately 3 days later a follow up portion of the surgery was performed to remove blood from the patients lung. During this follow up, the surgeon "accidentally" inserted a steel probe drainage tube through the victim's lung into his spleen, the victim died due to surgical malpractice! The operating surgeons admitted that they caused the victims death! The family of the victim received a settlement from the surgical malpractice and it's pretty obvious that the victim's wealthy family is using their financial power to hold me oppressed. In incarceration beyond any moral limit of punishment! Alabama is not at this point a truth in sentencing state, or shall I say It was not when I took my 20 year plea bargain-The lawyer advised me that I would only serve 6-8 years of incarnation , and I was psychologically forced into the plea bargain agreement. Right before the trial began, I offered to take a 10 year plea because I did do wrong by shooting the man, my lawyer-Sherman B.Powell JR. of Decatur.
Alabama talked to the D.A, and came back with a 20 year plea, at this point I offered to take a 15 years if the two thefts were to run concurrent and my mother only received probation for her hindering prosecution of aiding me, my lawyer talked to the D.A, and then advised me that the D.A said that I could take the 20 year plea agreement or he would give me life due to my three felony strikes and my very lengthy juvenile history of criminal behavior, and send my mother to prison with me.
I was in the ALA. D.OC. 11 years before I could talk my lawyer-Sherman Powell JR-and make him aware that the victim died due to a mistake in surgery. During 11 years of incarceration and 3 parole consideration hearings-The D.O.C had it written in my institutional file that the victim later died due to my assault, and to this date my institutional file reads that the victim died from complications during surgery and it does not say who's responsible for being the cause of Death me-or the surgeons!!!
It's not hard to see why the Alabama department of corrections is extremely over crowded-cause these redneck ignorant people are still practicing their twisted forms of prejudice classism and exaggerated lies, and there's nothing that can be done about it!
