Accidents have no intents On July 28, 2000 we had a special speaker event at Trial where the DOC Commissioner Sheryl Ramstad Hvass and some Hazelden Foundation bigwigs told us they were uniting on C.D. $tuff. We were allowed to address these big wigs and in front of 300 people I told Ramstad that my P.D. took advantage of me and that she had an innocent man in one of her bed spaces that wanted help. I explained a little about my case and how emotionally and mentally trying it had been on me. Ramstad responded to me, but I was so nervous after I sat back down that I didn't catch her response. Twice after that event I called Ramstad's office and left messages that I wanted her help and she got pissed nad had me kicked out of treatment and L.L. and shipped way the hell up north to the Moose lake facility. I started going to the law library and working on my case 24/7. I couldn't afford an attorney or get help from anywhere, so I decided I'd petition my government for help. I spent a few weeks and several hundred dollars in creating and mailing this petition called "Beef - Stew," and named that because I had a lot of beefs. It was 24 pages which consisted of a 1 page cover letter, 3 page affidavit, and 20 different legal documents. It was proof that my judge, DA and especially by PD all conspired as a team and wrongly convicted me, I sent this to 59 professionals of Minnesota.
Ramstad has be segged on October 19, 2000, all my legal materials confiscated and then a false report made against my 'Beef - Stew' petition. It had 59 counts of each of 4 different rule violations and narrated some of my legal content, but only gave this one incident description, "In this letter Krych makes false claims that he has been denied help." They put down facility employees (canteen, laundry, etc.) and claimed they've helped me. I wasn't told at the hearing what I did wrong and the report when under a 2 week advisement where Ramstad arbitrarily, and capriciously made bogus guilty verdicts against my legal work. She found me guilty of "threatening others" for writing "accidents have no intents" and didn't say who I threatened in her rationale, but wrote "direct threat." She gave me 120 days seg with her "direct threat."
I've refused to leave the safety of seg 10 times so far because I won't heed Ramstad's "direct threat" and fear retaliation for exposing this and continued work on my case. My first discipline hearing for refusing to leave seg was on Nov 7, 2001, and I submitted Governor Jesse Ventura's 'Beef - Stew' response (it got put on the record) and said that I got punished and threatened by Ramstad for legal work the Governor (who appointed Ramstad) found nothing wrong with and I feared for my safety. Jesse got wind of me including this office in my hearing and sent me a Nov 8, 2001 letter (artfully written) which said he didn't do anything wrong and to not share his letter with others and he sent Ramstad a copy of this. I've been denied the right to present documents at every disciplinary hearing since then and it's been a non-stop 'Beef-Stew' covering up conspiracy. Ramstad served 25 years in the judicial system before her commissioner appointment.
Call it karma or whatever, but in Nov 2002, Ramstad got snitched out. She snuck a cell phone into the Lino lakes facility and let prisoner (ex-judge) Amundson make personal calls on it, and the guards told on her. She said she was just talking to her friend and former colleague, Amundson, when the phone range and it was for him. Professor of Corrections, James Robertson, called her story "far fetched" and said "Clearly it sends a message to the inmate population that there are two standards of justice. And some special offenders get much better treatment."
The Ramstad-Amundson scandal is some twisted-ironic stuff when you add it to my situation. Amundson was the first recipient of my 'Beef-Stew' petition and I put him first on the list because he's the only person in this State (Minnesota) that ever did me any justice, and he had to get himself locked up. He was my appellate judge that dissented, because "the jury did not receive any instructions that would communicate to them that intent was an element of this crime," which is my innocence ("Accidents have no intents") that Ramstad used to threaten me with.
I got nice 'Beef-Stew' responses from the Governor's, Secretary of State's, Attorney General's and Public Defender's offices, to name a few, and not one recipient complained. Consitutional law says that the addressee as well as the sender of correspondence derives from the First and Fourteenth Amendments a protection against unjustified governmental interference with communication and Ramstad never mentioned a "security concern" once.
I got put in a max facility because of my innocence and it costs more to house me here than it did in the medium facility where I come form. Now I'm in the new super max section too. I was seg free my whole bid (31 months) and my outdate used to be 7-10-2004, but because of Ramstad's arbitrary destruction of my legal work/treat, I'm not getting out till 2005 and they keep pushing my outdate farther away because I won't leave seg. Taxpayers will pay for every extra day I stay in prison past my original outdate and there's no penological reason for me staying in prison longer than I have to. The MN DOC has about 400 seg bed spaces that are always full (they can't waste bed space) and for every 3 days a prisoner serves in seg his outdate gets extended one day and the taxpayers pay the DOC to keep him longer.
