www.prisoncensorship.info is a media institution run by the Maoist Internationalist Ministry of Prisons. Here we collect and publicize reports of conditions behind the bars in U.$. prisons. Information about these incidents rarely makes it out of the prison, and when it does it is extremely rare that the reports are taken seriously and published. This historical record is important for documenting patterns of abuse, and also for informing people on the streets about what goes on behind the bars.

We hope this information will inspire people to take action and join the fight against the criminal injustice system. While we may not be able to immediately impact this particular instance of abuse, we can work to fundamentally change the system that permits and perpetuates it. The criminal injustice system is intimately tied up with imperialism, and serves as a tool of social control on the homeland, particularly targeting oppressed nations.

Solitary Confinement at Ely State Prison (Max)

I was just given 1 year in the hole by these fascist pigs who want to see me break down and give in. Not only do they put me in solitary confinement, they put me smack dead in the middle of two mental patients who have lost their grip on reality. I truly believe this was an attack on my sanity because when I receive my meals I hear the pigs say it must suck to be you and things of that nature. I just look at them and give no reply.

The madness starts about 11pm every night, I call it party time. Doors get kicked, the screaming begins and toilets get banged on. I ball up wet tissue and stuff it in my ears. This helps a little bit but I can still hear every word that is being spoken. The first few nights were rough but I managed. I was getting upset at my neighbors for making all the noise, but I had to sit back and realize what was going on. I know that being in solitary confinement can break down the most active comrade, I've seen it go down and I'm pretty sure those who spend years in the hole for being an unruly tenant have seen it as well.

To all comrades who are cussing these dudes out, ask yourself about those prisoners being disruptive. Are these cries for help cuz just being in a cell 24/7 is to much for them to handle and it's beginning to weigh on them mentally? I notice that these cries for help are met with the goon squad running in on them or these doctors forcing meds on them which they don't need. All this does is drive them deeper and deeper into depression and despair.

Animal rights agencies have gotten laws passed to ban this cruel treatment of animals but the government is still allowed to inflict this cruel treatment on humans, imagine that! The United $tates federal courts have acknowledged and ruled that solitary confinement causes sensory deprivation which in turn causes substantial psychological damage, this is no theory but a fact. Some common symptoms from sensory deprivation are paranoia, anxiety, depression, aggression and psychosis.

Our oppressors can change the name or paint it a pretty color but it's still solitary confinement. I guess they believe this tactic is working to subdue the rowdy cons and to turn prisoners against each other. But what prison officials don't realize is that they are going to eventually release a beast that they created back to society and when this home grown prison beast is released and kills someone officials have the nerve to act offended and prosecutors call him an animal and charge him just to put him back in solitary.

Right now I'm next to a young white brother who is on meds. He's 19 years old and has been in the hole for 1 year but from time to time he goes a little off the wall. He just had a psychotic episode where he threw shit on one of these pigs and just a few days ago he found out that he was being AG'd (the Attorney General wants to file new charges on him). Now he's looking at more time in prison and in solitary confinement where his mental state will surely get worse. What good is this doing? So instead of us talking shit and lashing at these people, let's take a deeper look at what's really going on.

MIM(Prisons) adds: This is a good letter illustrating the torture that is the long-term solitary confinement units in Amerika's criminal injustice system. The fight to shut down these Security Housing Units is a key part of the battle for better conditions. This is a tool for educating and organizing, and we need to unite rather than criticize those who are suffering in these units.

Fighting Repression in PS Housing

On April 28, 2011 a complaint was made against two lieutenants and the associate warden of operations (AWO) at Lovelock Correctional Center (LCC) for threatening the entire Protective Segregation (PS) housing unit population with group punishment if the gambling, homosexual activity, tattooing, etc. continued, despite the fact that those who'd been caught were known and identified and/or already facing disciplinary procedures.

The same night, a number of individuals were caught gambling, and the following morning both PS housing units 3A and 3B were locked down. The lockdown was purportedly in response to the gambling incident.

On May 10, 2011 a minor altercation occurred between two prisoners in the LCC dining hall. These two individuals were placed in more secure housing where they received:

  1. telephone access
  2. law library access
  3. library access (i.e. book cart)
  4. cleaning supplies for cells
  5. full food portions in two hot meals per day
  6. yard access
  7. due process prior to loss of privileges and punishment

The remaining PS prisoners in 3A and 3B, having nothing to do with any of these incidents, received:
  1. lockdown for 6 days with showers on first and fourth days
  2. loss of cell visiting privileges (permanently)
  3. loss of open access to cells and toilet accommodations (permanently)
  4. no law library access
  5. no religious access
  6. no library access
  7. no telephone access
  8. no cell cleaning supplies
  9. no tier time/yard time
  10. refused grievances and "advised" not to "fly paperwork if we want off of lockdown"

During the lockdown a shakedown (described as getting the unit into compliance) was done resulting in the confiscation of appliances, which was later returned because "it should not have been taken in the first place."

Upon being let off of lockdown some of the population united around these and other issues long overdue for redress and formulated a complaint alleging several violations of civil and human rights which are embraced by the following acts and holdings among others:
22 USCA 6021 (9)
22 USCA 6401 (in toto)
42 USCA 1997a (CRIPA)
42 USCA 2000cl (RLUIPA)
Bounds v Smith 37SCT1491 430US817
Heck v. Humphrey 114SCT2364 512US477
Wolff v McDonnell 94 SCT 2963 418 US 539
Breenholtz v Nebraska 99 SCT 2100 442 US 1
Estelle v Gamble 97 SCT 285 429 US 97
Turner v Safley 102 CT 2754 482 US 78
All of which are US Supreme Court holdings which are binding upon Nevada (Nevada constitution article 1 Sec 2 Bargas v Warden NSP 482 P2d 317 87 Nev 30 91 SCT 1267 403 US 935 29 LED 715)

The complaint raises the following (and other) issues which are constant and pervasive conditions at LCC among PS prisoners:

  1. unsanitary/unsafe dining hall conditions
  2. inadequate food and medical treatment
  3. compulsory strip searches daily (to boxers) frequently done by females
  4. verbal abuse by staff in the form of derogatory racial, cultural and gender charged epithets
  5. abusive and retaliatory behavior toward adherents of non-traditional religions
  6. inadequate legal access and retaliation for accessing legal process
  7. coercion/harassment in the form of cell searches and theft/destruction of personal property as retaliation and for furtherance of personal agendas
  8. withholding/theft of mail, opening legal mail outside of prisoner's presence
  9. use of prisoners in supervisory capacity and as facilitators/teachers of rehabilitative and psych programs which impact earned sentence credits, parole board decisions and sentence duration
  10. fomenting hostility and animus between prisoners using confidential or otherwise sensitive information
  11. group punishment/threats of collective retaliation and punishments

The above is a summary of the mentioned complaint and does not contain much in the way of detail and specificity. However, it serves to articulate the overall conditions here (and elsewhere) and exemplifies the need for solidarity and presenting a united front against oppression. It should never be allowed to get this bad before action is taken, but it apparently must get bad enough to inspire action.

It is easier to keep what one has than it is to regain what one has already lost, but this is not a message which is widely understood by the new prisoner class.

In any event, if information concerning our struggle becomes available, it will be put "before the world."

MIM(Prisons) adds: We applaud prisoners coming together to fight repression in their housing units. In this case it is prisoners in protective custody, a place our prison comrades are fond of reminding us is rife with people who informed on other prisoners (often falsely) to save their own hides. We cannot often know who, in PC or general population, is a snitch, but we can judge prisoners by their actions and uphold the correctness of struggles against prison brutality wherever they arise.

Ely State Prison: Depravity, Despair and Death

Ely State Prison(ESP) is a place of death, stagnation, misery, pain, loneliness and indeterminate lockdown. If you were to take a walk on one of these depressing tiers back here in "the hole," you would hear many disembodied voices ring out, yelling in anger and frustration, trying to tell you how bad it is for us in here, in between the isolated confines of steel and stone.

This is a maximum security prison, but not everybody here is a security risk, but if you were to ask these pigs that, they'd probably tell you otherwise, just to try to justify the fact that they're keeping us warehoused in here, whether we deserve it or not. With time things change, and usually for the worse. Deterioration is a normal occurrence in here. In fact, if you were to ask the prisoners around here if they think the conditions here will get better or worse, most of them will tell you things are only going to get worse. Pessimism and hopelessness permeate the minds and attitudes of the average prisoner in here. There's nothing much to look forward to, besides the next meal, and maybe a letter in the mail, if you're lucky.

Back in the day, ironically when ESP was opened (when we were allowed group yard, tier time, porters, etc.), the majority of the prisoners here were actually befitting of the status: maximum security. Back then, a man was sent to Ely State Prison for failure to adjust in another, less secure prison, violence, escapes and things of that nature. But even then, that could also mean he was disruptive, someone who organized other prisoners, led religious services, or filed too many legal writs or grievances.

Not every man at ESP is told why he's here these days, and not every man here has committed a violent crime. Not every man here has done anything serious to even warrant maximum security status. For example, I have a neighbor here in the hole with me right now who was transferred up here simply for contraband. A prisoner has no chance to appeal a transfer before being sent to ESP, and sometimes arrives in the middle of the night without warning. Brought into a world of darkness, locked into a cell, left to get stale and stagnant as he deteriorates, like a moldy piece of bread.

Nobody belongs in a world where they're buried alive, where they're in a tomb for the dead, basically. The police have total control, and many of them frequently abuse that control, either on a psychological level, or on a physical level. And over the days, weeks, months and years, a prisoner who is confined to this every day misery, begins to degenerate. I've seen it happen, over and over again. Nobody belongs in a world like this, where death permeates the atmosphere. Where pressure is applied so constantly that all it does is make these men hard and mean as time goes by.

Some of these guys in here feel they only have 2 or 3 choices now: escape, snitch or suicide. Nobody has escaped from here yet, but many turned into snitches, and many have committed suicide. And others have succumbed to psychotropic medications, which is a form of both escape and suicide. For so many of us in here, there's nothing to strive for, no aim, no goals, no hope, no light at the end of their tunnel, and they just give up; give in. There's no love here, just the artificial love that you'll find in the gang culture of prison life. This is a terrible place to be, especially for someone who has to return back to society.

All you have to do is read a little psychology to figure out what's going on, to understand what's being done to us in here. They try to break us down, sever our family and social ties, dominate us, talk shit to us, treat us like children, going out of their way to try to keep us stagnant and ignorant, and always out to break our spirits. Needless to say, I pass around books, articles and notes on psychology, so that prisoners can get a deeper understanding about things. Not just about being in prison, but also about how our minds work, personality, emotions, why we act the way we act, and why we are the way we are. It's very important to actually be able to come to an understanding of these things; to raise our level of conscious and to be able to elevate our thinking under these circumstances is very important in more ways than one, and it's also necessary for our survival in here, where psychological warfare is being waged on us every day.

The depravity and despair in this graveyard continuously pushes men to death or insanity. I wrote an article on November 18th, 2009, about the mysterious death of death row prisoner Timothy Redman. Nov 18, 2009, was the day he died, and I was there when it happened. This is a prime example of the daily depravity that takes place in this hellhole. Approximately an hour after Redman allegedly tried to grab a correctional officer by the wrist and pull his arm through the food slot (apparently the pig had to struggle to free himself), an extraction team of officers was made up to physically and forcefully remove Redman from his cell, or at least to try. Redman refused to surrender and to be placed in handcuffs, and he did so by displaying a weapon. What's cold about this whole thing is that the policy (administrative regulation) even states that any time a prisoner has a weapon in his cell, his water and toilet is to be shut off, an officer is to be stationed outside of his cell, and nothing is to come in or go out of his cell - not even meals, and this officer is supposed to stay stationed outside of his cell until the prisoner either gives the weapon up, or for 72 hours, and then they have to decide what to do from there, whether excessive force is to be used or not. Did this happen? No. These pigs refused to follow their own rules and a man died as a result.

A Story of One Man's Death

I can tell you exactly what took place. After Redman refused to surrender, the pigs then proceeded to spray one can of pepper spray into his cell. After that the senior officer in the control bubble commenced to open Redman's cell so the pigs could run in on him and retaliate, and then remove him from his cell. But the cell door was jammed from the inside, and they couldn't get it open. Obviously Redman was no dummy, he knew how to keep the pigs out, and he knew why it was so important to do so. That's a situation that you usually don't win. They come in and beat your ass, and after they've got you fully restrained, they beat you some more as they yell out "Stop resisting! Stop resisting!" So, over the course of two hours, the pigs emptied a total of 6 canisters of gas into Redman's cell, and then sprayed a seventh canister one time. They would spray him, and then go hide out in the upper storage room, so that the gas wouldn't affect them (Redman was housed in 3-B-48, right next to the upper storage room). When they were finally able to open Redman's cell to get him out, he was dead. His face was purple, his body was blue and blood was coming out of his nose. His boxers were stained with feces and urine and he had what appeared to be a smile on his face. The nurses and doctors tried to revive him, but to no avail.

What's mysterious about this whole situation was that when they pulled Redman out of his cell, there was no rope tied around his neck or anything. But they say he hung himself. They said it was a suicide. But did he really hang himself, or was he murdered by six cans of pepper spray? Was it a cover-up? People need to be concerned about this, and they should demand to see the video footage of the extraction, just to make sure. Because the whole things seemed mysterious to the majority of the prisoners who saw the incident take place.

All seem to agree that Redman died from the pepper spray. They think he was murdered. Who knows what happened. Death row prisoners have been murdered before under McDaniel's administration. I know this much: a couple of hours after they carried Redman's body out of the unit, two of the wardens, the coroner, and the investigator were all standing outside of Redman's cell laughing, smiling and joking around, thinking it was funny. I piped up and said, "What are you laughing at? If that was one of your own who died, you wouldn't find it very funny, now would you?"

The really cold, cold part about it was, when the coroner asked the warden, on two separate occasions, "How should I decide this?", "How do you think I should decide this, suicide or murder?" The warden looked around, seen that prisoners were standing alert at their doors and said "I can't decide that, that's your job." But what would even propel the coroner to ask such an odd question like that in the first place?

I knew Redman personally. He wasn't really a friend of mine, but someone I talked to occasionally. I don't know what set him off to go after the pig, but i do know this: Redman was a death row prisoner who had had to endure 23-hour lockdown while on HRP (High Risk Potential status) for 16-17 years straight. I heard him talking once about how the administration is stripping one privilege away from us each year. Tobacco, milk, scrambled eggs, hot lunches, food packages, clothing packages, etc. They just take, take, take and keep you locked down in a cell with a death sentence hanging over your head. Oh yeah, and I know that they were messing with Redman's mail too. He seemed to think that his wife left him due to this; because certain letters never got to her. So i think it's safe to say, with all those things taken into consideration, you have a man who has nothing to lose, and no hope in sight, who has basically been driven to a point where life doesn't even matter anymore.

Systematic Problems Require Organizing

There's a lot of people like that in here. They weren't always like that though. They've deteriorated, and have been broken, and just stopped trying, stopped caring, with no one or nothing to help pull them through. It's a sad sad story, about depravity and despair. Some of us fight and struggle trying to make it through this, trying to better ourselves and better our positions in life, and some just give up all hope. It's easy to give up in a filthy, foul-ass place like this, where nobody cares about what you're going through, or about what happens to you, one way or another.

The guards who work here don't care about us, they're not trained to care about us, they are only trained to control us. Ely State Prison is an unproductive, unhealthy environment, even for these pigs. it has been documented that prison guards have the highest rates of heart disease, drug and alcohol addiction, divorce - and the shortest lifespans - of any state civil servants, due to the stress in their lives. Prison guard are in constant fear of injury by prisoners, and the fear of contracting diseases always lingers in their minds, since prisons are normally flooded with all kinds of diseases, from hepatitis C, tuberculosis, to AIDS.

From the first day in the academy these guards are trained to believe that they are the "good guys" and that prisoners are the "bad guys." They are pretty much programmed into fearing and despising us - before they even come into contact with any of us! They are led to believe that all prisoners are manipulative, deceitful and dangerous, and that all prisoners are the scum of the Earth. So no, they don't care about us, they are not even allowed to care about us. We are not even human to them. Needless to say, none of this leads to rehabilitation, but on the contrary, it only contributes to the everyday depravity here in this hellhole.

I'm writing about all of this for a reason. I'm here to expose the abuse, the disparity and hopelessness. I'm here to raise awareness about all of these things, and I'm here to help seek solutions. One of the things I'd like to help Nevada prisoners understand is that the situation for us out here is deplorable. There is a real problem with this whole system, and if we don't recognize these problems, we will never find solutions, not to mention the possibility that we ourselves could even be contributing to many of these problems. Please believe, the way they've got us doing our time is not the way we're supposed to be doing our time. This whole prison is "the hole"; there's no general population here at ESP, there's no incentive, no programs, no rehabilitation, nothing. We have way more coming to us than this! We are not supposed to just lay down and accept this, we have to start finding ways to come together, we have to start striving to make the necessary changes that will help better our positions in life, so that we don't have to keep coming back to these dead ends.

Furthermore, there's no real level of activism in Nevada. Prisoners do not have any available resources, bookstores for Nevada prisoners, no prisoners' rights advocacy groups, no solid help from the outside, whatsoever. In order to make changes on the inside, we need support from the outside. We must take it upon ourselves to build a proper support structure for Nevada prisoners, and we have to do this from the ground up!

So, if you're a prisoner doing time in Nevada and if you have family/friends out here in Nevada - or anywhere else on the outs - I would like to encourage you to explain to them how bad the situation is for you/us in here. Let them know that we cannot expect any type of real rehabilitation from this system; explain to them that the administration is not going to do anything to help us further our growth and development, or push us close to becoming reformed, socially functioning individuals. We have to take it upon ourselves to do these things and we can't do it without a proper support structure from people on the outside.

Talk to your families talk to your friends, talk to your loved ones out there (show them this newsletter if you have to), see what they would be willing to do to start up programs for Nevada prisoners. Something needs to be done, but nothing will improve unless prisoners start taking the initiative.

The guys who have to do life sentences, or who have to be here for the duration, I encourage you to start learning the law, use it as a tool to make changes for everybody; start stepping up to the plate, instead of waiting for others to do it for you. As long as we keep trying, sooner or later something has to give. It's better to try than to do nothing, especially when we're living like this! We can do anything we put our minds to, it all starts with a thought, and what we think about we become, so let's get cracking!

Until then, we are just going to sit here, warehoused in this misery, as the years go by, more people losing their minds, more deaths and suicides, more repression, more rules being placed on us, making it harder on us, more restrictions, more losses of privileges and whatever else they want to take from us. We will sit here with sad looks on our faces, as anger and hatred eat us up inside. The despair will lead to depravity , and the depravity will do us in. Death is the only outcome tomorrow, for those that don't start taking action today.

MIM(Prisons) responds: This is a good discussion of the need for activism in the context of concrete examples of repression and brutality in the criminal injustice system. Further, this writer is correct that there is a bigger context to the repression that is an inherent part of the system. We do not believe that psychology is the appropriate place to look for answers, but it is useful to understand systemic motivations and factors. See our article on mental health in ULK15 for more analysis on this.

USW organizing in Nevada

I received your recent missive; thank you for the USW information. I understand you do not have a USW chapter in Nevada. I am not surprised; in fact, I suspected there wasn't, for there is no revolutionary core among the oppressed nationalities. I will assume responsibility of USW leader in Nevada.

There is an extreme lack of literature circulating among Nevada prisoners to begin breaking new ground and give rise to a revolutionary core here. To illustrate my point: the side I'm on, housing over 100 prisoners, has no political material in circulation, except my literature. I'm the only one on my side with political material (and the Wall Street Journal). Because of this, I find that lack of political education - or lack of choice to be politically educated - to be a hinderance to establishing a revolutionary core.

Simply put, we need more literature in circulation.

Generally, Nevada prisoners suffer from the same injustices endured by prisoners at large: education issues, medical, control units, etc. However, we have issues that are unique to us and we must struggle against alongside general issues. I am preparing a platform in harmony with the goals outlined in your letter.

This letter is to officially declare that I will lead in the tasks of erecting USW in Nevada.

Correction to ULK1 Legal advice on CA ban

I just got done reading your November 2007 newsletter Under Lock and Key. Impressive reading!

On page 3 “CA prisons ban MIM” you made a serious error. You cited bad case law concerning prisoners receiving mail under the Procunier v. Martinez standard. In 1989 the U.S. Supreme Court in Thornburgh v. Abbot, 490 U.S. 401, 413-14 partially overturned Martinez. In Abbot the court held that the Martinez standard should apply only to a prisoners outgoing correspondence. For incoming correspondence, a different standard applies. This new standard comes from a case called Turner v. Safley, 482 U.S. 78, in which the Supreme Court stated that restrictions on incoming mail are valid if they are reasonably related to a legitimate penological interest. Also see Abbot at 413.

If inmates go to court to fight the ban on MIM and its incoming publications and correspondence, they could wind up loosing hard if they use the wrong case law such as the Martinez standard. On your next publication of your newsletter, I would recommend posting a correction advising inmates to use the Turner standard.

Ely State Prison: Are Officials the cause for Prison crimes?

Nevada recently passed new "No Smoking" laws, and Ely State Prion (ESP) is using these laws to say that prisoners can't smoke in their cells. Because of this, they now ignore the classification procedure that does not allow smokers and non-smokers to be placed in the same cell. Before the rule that has abolished smoking in the cells was implemented ESP released a memo listing outrageous sanctions that will be imposed on prisoners who refused to accept obvious enemies as cellmates. Due to fear of the sanctions, prisoner refusing cellmates has ceased in large measure.

I've been placed in the hole for staging a protest because they put me in the cell with a smoker. I went to my 1-hour yard and refused to return to my cell until they moved me I was charged with G1: Disobedience of an order of any correctional employee or anyone who has authority to supervise inmates in work or other special assignments; G14: Failure to follow posted rules and regulations; and a MJ28: Organizing, encouraging or participating in a work stoppage or other demonstration or practice. I was sanctioned with five days DD., which means five days in a bare cell It is a psychological attack; an assault on the mind to drive prisoners crazy.

A lot of conflicts between cellmates, many of which result in new criminal cases, are a direct result of negligent classification practices. They are putting Bloods and Crips and other rival gang members in the cell with one another, smoker with non-smokers, etc.

Although they have always put smokers in cells with nonsmokers, now they believe it is legitimate to do so. This new practice once again shifts a heavy burden on prisoners, particularly non-smokers. We all know that a smoker will smoke, and he has a right to do so. Yet, if a non-smoker complains that his cellmate is smoking, then he's snitching! This is exactly what the Senior C/O told me to get me to call off my protest. Since ESP's interpretation of the new laws means that it is illegal to smoke in the cell, then non-smokers are snitching if they complain. The law bans smoking in certain public places and areas, and ESP extends it to inmate cells. I beg to differ. A prisoner's cell is not a public place because he lives there. It is his residence, his home. As such, prisoners have a right to smoke in their cells. Prisoner smokers should maintain this view and protest. ESP is trying to make prisoner smokers sit in their cells for 23-hours a day without smoking. And as EPS prisoners know all too well: there are more 24 hours days than 23 because we don't always get our 1-hour yard.

In order to stop any Uprising and Protest ESP will employ the same tactics they did to get prisoner to stop refusing unwanted cellmates - suppression. Every time a non-smoker complains, the smoker will receive a Notice of Charges (NOC). since no one wants to be labeled a snitch, non-smoking prisoners will stop complaining But, as with so many other conflicting classifications being forced to live with one another, it will manifest as fights and stabbings between cellmates, which will send a new wave of criminal cases to White Pine County Courthouse and fill its calendar.

Why is ESP so content with forcing mixed classifications to live with one another at the very risk of our lives? Instead of being responsible mediators they implement rules and policies that make them systematic instigators of the blood that is shed by ESP prisoners.

Prisoners being beaten and stabbed and catching new cases are the unspoken affects overcrowding is having on us. Because of the overcrowding population, classification is creating rules and policies that relieve them of responsibility so they can put any prisoner anywhere; otherwise, ESP would be gridlocked. However, ESP's whole administration is rigid. There are numerous ways through which they can rectify overcrowding. ESP has 8 units. Units 1-4 are lock-down units, and 5-7 are general population units, but with the exception of few "privileges", units 5-7 are just like the lock-down units. Unit is the only open unit and it is the workers Unit. Simply put, if you are not in Unit 8 you are locked down 23 hours a day.

Caseworkers often tell us that the only way to get transferred is by first going to Unit 8 first. However, since the eligible prisoners from Units 5-7 are trying to get to one Unit, somebody must be left behind. There are too many prisoners trying to get to one Unit. So, discrimination and favoritism ensues. If a prisoner catches a new case while here ESP that puts a five year hold on him, meaning he can not transfer for at least five years, assuming he has five years left on his prison term. If a prisoner has recently arrived and has a life sentence, or more than one life sentence, he must do at least 1-2 years on each life. If you are a Mexican, you are not allowed to go to Unit 8 at all, but must remain locked-up until they decide to transfer you. Some prisoners, like escapees, they say, may never transfer. My list goes on.

The point is that ESP has all these policies, including the acceptance of non-violent, petty theft prisoners into this Maximum Security Prison, to make it seem like they are tough on us. Instead of rearranging how they determine who to accept, what cases to put before the courts, how long prisoners must stay before they are eligible for transfer, etc. They just make up new policies and guidelines and force prisoners to stay with each other, regardless if they are rival enemies, smoker and nonsmokers, etc. Should they abandoned some of the foregoing policies so that the ebb and flow of prisoners through ESP can run more smoothly, it would appear that they are growing soft. So, they neglect classification procedures, throw us in the cell with anybody, and let us kill each other. Then, it appears that we are just being criminals, which the public expects, and they continue to look like the good guys who are tough on crime. Yet, many of the crimes committed at ESP are not due to prisoners willingly engaging in criminal acts, but because of the negligence of a poor administration.

The Bible or the Bullet?

How often do we analyze the connection of religion with terror and oppression? Likewise, how much do we seek to minimize the role of Christianity in the imperialist and sinful occupation of America?

They came troding on their horses like thieves in the night; holding a musket in one hand, and a Bible in the other. They were offered as presents to the peaceful, native inhabitants; yet, they had to choose - the Bible or the bullet? To live peacefully and share America with the native people wasn't enough for these new strangers, they wanted complete control over every facet of this land.

Native blood filled the trenches of European savagery, and tears of the children brimmed the gulch of mourn. The squalling of native women vibrated throughout Mother Earth as their thighs sanguine with virgin blood from rape. In plain daylight, they could see the Grim Reaper crouched over to catch his breath from the restless slaughter of natives. The only alternative to this hideous crime is acceptance of the Bible.

At the arrival of merchant ships were crowds of black faces with the obnoxious smell of slavery; millions of lives were expired on the Middle Passage, decorating it with the Holy Grail of Africans. Then, by force of the goad of death they were ushered into the fields of back-breaking labor. Their blood seeped into the cotton they picked, and tears fertilized the soil that grew the master's economy. The only alternative was acceptance of the Bible; given to pacify the hopeless slaves with a false sense of faith and spiritual dignity.

"Were I to be again reduced to the chains of slavery, next to that enslavement, I should regard being the slave of a religious master the greatest calamity that could befall me. For of all slaveholders with whom I've ever met, religious slaveholders are the worst..." (Frederick Douglass, Narrative of the Life of)

Today, the courts of law have strong links to the imperialist religion of Christianity and its Bible. In fact, it's the FOUNDATION of their laws, so they protect it. It is the peace-offering and balm for oppression, without it you'll receive the bullet. Since Christianity play an important role in carrying out the imperialistic agenda of capitalism, tantalizing the minds of the oppressed; then, America's laws are also rooted in such a design. One of their law books says: "It has been broadly stated that the common law draws its subsistence from Christianity, that Christianity is part and parcel of the common law, and that the Bible is the foundation of the common law. However, these statements have been held to have application in a qualified sense, in that Christianity's divine origin and truth are admitted, and the law will not permit Christianity to be reviled and ridiculed openly, and will punish such acts as tending to a breach of peace and jeopardy of the public welfare, as discussed in Blasphemy...1" (5A Corpus Juris Secundum (C.J.S))

The only reason this religion is so "legally protected" is because it is in fact the foundation of American life. The Bible's history is linked to and condones territorial expansion; so, its the best source of religious justification for imperialism. If one submit to the religious tenets of Christianity, oppression will go smoothly. The master gets to do what he pleases and the oppressed accepts it. However, opposition to this placebo religion will be met with the bullet! The Bible or the bullet, the American way of life.

You can not believe in Christianity and not capitalism; and you can not believe in capitalism and not believe in racism, they all go hand in hand! Hence, Christians may publicly deny Christianity's gruesome role in perpetuating tyranny, however; it just proves this enemy is a chameleon, and its conspiratorial design must remain masonic in nature. So, while protesting his system, we subliminally give him genuflection during sanctimonious services. Then, we pray to him in our legal papers with statements like:

WHEREFORE, Petitioner PRAYS that the Court grant Petitioner relief to which he may be entitled in this proceeding.

WHEREFORE, Petitioner PRAYS of this Court to appoint counsel to represent Petitioner.

One of the greatest curses from which American victims suffer is immunity of our perpetrators-government officials. They protect their employees of organized crime by granting them immunity from liability for their actions. In exchange for protecting capitalist interests of the government, he's protected. He's told to ignore his moral conscience in his despotic exercise of power. Official immunity is political bribery, as it encourage immoral acts by waiving accountability. He "can not be held liable for the neglect of the duty of that body...If there is a refusal, neglect, or failure, with respect to the exercise of power or discharge of duties of such body, IT IS THE DEFAULT OF THE BODY, AND NOT OF THE INDIVIDUAL COMPOSING IT..." 67 C.J.S. 206. The following is a statement made by Spec. Charles A. Graner, one of the U.S. soldiers allegedly involved in the torture of prisoners at Abu Ghraib prison.

"The Christian in me says it's wrong, but the Corrections Officer in me says I love to see a grown man piss himself..." (as quoted in The Washington Post, May 22, 2004).

It is men like him the doctrine of immunity protects. Now, if he can't be held responsible for his actions; that it is to the default of the body itself; then, how can you hold the body responsible for negligence of its duties to the public? You can not grab capitalism by the horn and drag it to an international court because it's an intangible structure! You can not charge capitalism itself for its exploitation and oppression of humanity, because it can only exist through its physical, human agents and abettors! And they can't be held liable for such an intangible "body," as it is the default of the body, and not of the individuals composing it - according to their own law books.

The fact that they are granted immunity proves they know the system is an unjust and immoral one. Why else would there be a strong need to protect them from punishment? As in slavery, slave-masters felt immune from moral accountability for the institution of slavery, because it was "ordained" by God when He "cursed Ham"; and they were only carrying out the duties imposed on them by God, who is also an intangible entity, for the institution of slavery! And to this day they have not shown public remorse for such a heinous crime. So here they are telling us to blame God Himself for the crimes committed against humanity, not them. Just as they are telling us to blame the governmental "body" and not the individuals composing it. Hence, perpetrators dexteriously evade punishment by placing the blame on intangible entities; and those whites who don't support this system are called traitors. Religiously and politically they escape punishment by using this tactic; religiously and politically they force whites to follow them for fear of being a traitor.

In America places like homeless shelters, ghettos, and prisons are cesspools of capitalism, the cellar of America's social structure. It is this element against which Congress pass laws, and against whom the courts enforce those laws and pass down punishment - not to corporate or government officials. Remember, the laws of America has capitalist roots; so it will protect and support any that help strengthen its imperialist design, it's the bullet!

Since capitalism can't escape its own nature, it find a way to capitalize on those below poverty level. It does this by making crime itself an economic market and scheme to create jobs for those willing to protect its interests. So you see the police patrolling the ghettos and harassing the poor. They're not there to prevent crime but to preserve it, to do so is to protect their asset-crime! Why else would police officers, prosecutors, judges, parole officers, etc. pursue these occupations as CAREERS when they publicly condemn crime? Some would say "to fight crime"; yet, these hypocrites must rely on crime for their livelihood for without it they wouldn't have a job! So in essence they actually support the very thing they claim to despise.

The support it to the point they provoke and partake in crimes against citizens, remember Rodney King, Amadou Diallo? They do it with faith their superiors will be loyal to them for their service in supporting the system. Unfortunately they're right most of the time by the fact countless brutalities and "justifiable homicides" go unpunished. The victims must watch the guilty go free; and justice, the ligament to peace, is broken asunder. Then there's civil unrest; a national outcry. Some go out in rage seeking to avenge the murder of the spirit of justice, and like the Rodney King riot, crimes are committed. So in the end they still profit.

Many American citizens are ignorant of how this structure operates because they have conformed to the Bible; and, censorship raised its ugly head in every institution in America to minimize detection of the bullet. It's the venom of falsehood they spit in our children's eyes, and make them blind of the truth about this nation's corruptions. They engender in our children a sense of patriotism America doesn't deserve. It's a process started early in schools with patriotic songs like:

"This land is your land, this land is my land, from California to New York Island..."

They raise our children with the false impression that America rose from a beautiful an humble beginning; implying the native inhabitants willfully shared this land with European immigrants, and everyone lived happily ever after. It's a cynical falsehood and denial of the bloody history of America. It is to deny the countless lives of Native Americans by greedy and desperate nomads in territorial expansion. Murder and imperialism spread like an epidemic across American soil, and attached itself as parasites to its native hosts.

The strong campaign of historical censorship by schools and media is responsible for victimizing our children. They victimize our children by instilling in them a sense of patriotism they may not have were education and media more honest. Yet, they grow up with this sense of patriotism, stolen from them through deceit, and join the military forces. In such forces they become the human agents of America's greatest source of international fascism and imperialism. As soldiers pumped with the embalming fluid of national pride, they go out and oppress the people of color around the world. When they arrive by water, air, and land; there's only one question to be asked - the Bible or the bullet?

[Control Units] [Ely State Prison] [Nevada] [ULK Issue 2]
expand

Long term segregation in Nevada

I'm currently doing 365 days in the "hole" (disciplinary segregation) at Ely State Prison in Nevada. There is only one unit in this entire prison that gets to walk the yard. The rest of us are on 23/24 hour lockdown and have to be cuffed and shackled and escorted any time we leave our cells. And not all of us are on disciplinary segregation. I was told that it's a federal law that prisoners are only supposed to get a maximum of 100 and something days in the "hole" but Nevada gets away with it because of our privileges. Some people are allowed to have appliances in the hole, and that's cool, but a lot of us either lost that privilege or can't afford that stuff, so we are forced to do 1, 2, 3, maybe more years, in the hole with nothing. Me personally, I'd rather only do a couple months in the hole with nothing and get back to a mainline, then sit back here years with a TV.

In this state they have slimmed down on the physical abuse so now they're going even more for the mind. And a lot of dudes can't take it. I request books from our library, but that's a joke, so I was given an old copy of MIM Notes to read from a comrade, and I was relieved to have something righteous to read, and I was also glad to know we have fellow comrades on the outside who are truly helping us in the struggle. Being that I'm fresh out of Y.A. (youth authority) and still a youngsta, it's been difficult finding info on the adult system. I never know where to look up, but MIM Notes has put me up on game.
