Under Lock & Key

Under the pretense of not allowing any harm to befall me, I was placed in Administrative Segregation (Ad-Seg). Texas law states inmates in Ad-Seg must be afforded at least one hour a day, every day, out of their cell for exercise and/or meaningful recreation. I stayed in Ad-Seg for approximately nine months, and at no time was I granted any time out of my cell. I suffered significantly due to this cage. Without exercise my muscles atrophied and now cause me severe pain. My mental state declined greatly, with horrible depression, thoughts of suicide, all around mental anguish.

Well, I wrote several grievances about these deplorable conditions, all of which were denied (of course). Then, I filed a formal complaint against Harris County Jail with Texas Commission on Jail Standards (TCJS). TCJS then responded that the "24 hour" lockdown was appropriate and they will not pursue the issue any further. I took the next step and filed a lawsuit (form 1983) against the jail, the Sheriff of Harris County, the Mayor and Captain over the detention bureau. I stated that they violated my 8th Amendment right (to be free from cruel and unusual punishment) as well as my 14th Amendment right (the right to due process). This civil action was filed 4 April 2012. There have been multiple motions filed both on the plaintiff's side and the defendant's. One mistake got me close to the case being thrown out. It seems inmates in county jails on "detention centers" are not protected under the 8th Amendment. They get to decide who is worthy or not of receiving rights guaranteed by the Constitution.

My case is still in the works, but when I get my day in court in front of a jury I'm confident I will win this lawsuit. I am suing not only for monetary compensation, but I'm trying to help my fellow comrades by asking the judge to declare this 24-hour lockdown illegal and immoral, and order the jail to cease and desist this barbaric practice.

MIM(Prisons) adds: In our ongoing struggle against control units we have seen the dramatic and detrimental health effects of this system of torture for social control. Even the United Nations has condemned long-term solitary confinement in Amerikan prisons. But still prisons and even jails continue to use this practice. This is not surprising since we see these units used as a tool of social control. Prisoners who fight the system in any way, or are perceived as educators or organizers of other prisoners, are isolated to try to limit their work. We have been collecting statistics on control units because there are no public numbers on the scope of this torture. To help with this project write to us for a survey about control units in your state.

Our struggle here in the belly of the beast continues! I'm writing to update you on the recent communication I received from the U.S. Department of Justice (DOJ) concerning the petition I sent them in regards to the grievance system. In the DOJ's response to my petition, they wrote, "The Special Litigation Section only handles cases that arise from widespread problems that affect groups of people."

I have not received a response from the many other mailing resources you indicated on the petition. Therefore I suggest that those engaged in fighting against this unjust Texas grievance system gather all petitions and send them to the U.S. Department of Justice, Civil Rights Division, Special Litigation Section, PHB 950, Pennsylvania Ave NW, Washington DC 20530. Comrades, let's flood their office with these petitions!

MIM(Prisons) responds: The imperialists will use every excuse in the book to justify their oppression. So one piece of our struggle involves making it harder for them to make excuses, which further exposes them as the willful oppressor. In that light we are promoting this comrade's suggestion as a next step for the campaign in Texas.

I was confined to Ad-Seg in Harris County Jail while my case was under trial. Texas law requires the jail to give prisoners at least one hour a day for exercise and meaningful recreation. I stayed in segregation for nine months. Not once was I allowed out of cell exercise. I filed grievances, which were denied. I then filed a Section 1983 lawsuit for violation of my 14th amendment right to due process. The litigation is ongoing, however the jail refuses to stop this barbaric and inhumane treatment of 24 hour lockdown. The "justice" system is failing to protect the incarcerated individual. Again.

I traded several of my meals to other prisoners for a few stamps. I was only able to gather 5 stamps. I know it's not much, but I hope it helps some. I have been spreading the MIM(Prisons) campaigns, and have put together a small group of other prisoners to remember the Attica uprising. We have planned a fast for September 9, 2013.

MIM(Prisons) adds: This comrade is organizing others to participate in the country-wide demonstration September 9. Calling attention to the treatment of prisoners, this demonstration coincides with the anniversary of the Attica uprising.

It seems as if all chaos has been released on this unit, as now the security officers and administration officers are denying prisoners here their prescribed medication. Medical wants to close evening pill dispensing at 5.30pm whether all prisoners get their medication or not, to avoid overtime. The unit is relatively small and if run by security staff properly, it could run pill window for all prisoners by 5:30pm. But the prison creates conditions that make this impossible, delaying count, shutting down prisoner movement, etc.

Because of a lack of proper medication several prisoners have had violent epileptic seizures. Other prisoners have gone days at a time without their medication. A building missed their medication three days straight.

It is obvious that the wheels have fallen off when the medical department blames security for such denials of a person's medication, and security blames medical by stating they "have no control over medical decisions."

Four days out of ten last month I myself missed medication, and I was placed in protected custody twice for speaking out against such blatant violation of our rights. Because of this, trouble is brewing that presents an environment that is hostile and unsafe for both officers and prisoners, a violation of our right to a safe and secure place to do our time.

MIM(Prisons) adds: Medical neglect is all too common in Amerikan prisons. This should be no surprise as capitalism puts profits before health, and in the case of prisons it puts social control before health. This is a clear example of the criminal injustice system punishing prisoners just for the sake of punishment. There is no possible rehabilitative purpose to denying prisoners their medicine. It is a way to put lives in danger. They might claim to save a few dollars on staff overtime in the short run, but the long-term financial cost of treating seriously ill prisoners will far exceed these savings as many prisoners are on medication critical to control serious conditions.

The abysmal health care in Amerikan prisons mirrors the situation on the streets in this country that spends more money per persyn on health care than any other in the world, but yet has far poorer health than most First World countries and even some Third World countries. Ironically this poor health hits the wealthy in Amerika too. These are some ways in which communism will serve all the world's people, not just the poor. Although the wealthy will be brought down to the same economic level as everyone else in the world, improvements in healthcare, an end to environmental destruction, and opportunities to lead productive lives are all important enhancements in life that all will enjoy when capitalism is overthrown.

In 2001 at the Lynaugh Unit in Fort Stockton while at medical out in the cage "outside waiting" a man came out of medical and turned around and hit the door, then fell out. The guard kicked the man and told him to go to his cell. Then the guard kicked him once more and told him once more to go to his cell. The man was dead! He had gone to medical to complain about chest pain. The doctor and nurse checked him out and told him that nothing was wrong. This is due to the lack of real medical attention given in prison.

MIM(Prisons) adds: Medical neglect is a serious problem in Amerikan prisons. While the government reports deaths in custody, they do not report how many of those were avoidable. Under Lock & Key reports many deaths as well as cases of medical neglect that do not immediately lead to death, but we only cover a small number of the incidents. Exposing this abuse is a critical element in our fight against the criminal injustice system. We need to share this information both with other prisoners and with people on the streets, and urge them to think about why we have a prison system that wants to let people die of neglect. This is not a system trying to rehabilitate people, it is a system of social control, serving imperialism.

I would like to respond to an article on page 8 of ULK33: Rats Undermine United Front. The brother who sent that in to you should be on something other than what he spoke about. I feel he should've been informing you about how these pigs down here continue to bring us cold food in lockup. How they mistreat Muslims during Ramadan and all throughout their stay here as far as how they are fed. It is so ridiculous how they so blatantly give you cold half-cooked, sometimes spoiled beans and a funky crusty peanut butter sandwich in place of a "pork-free" meal. There's a sign posted in all the chow halls that says "drink at your own risk" when it comes to the juice. They put this poison out on the tables knowing that the majority of the offender population is more than likely going to drink it. We are not getting the proper portions, or enough to eat.

When you write a grievance and a step 2 followup, you get some type of frivolous disposition back on it. I have several grievances from different offices, all with the same disposition on them. It is as if the employees are trained with what to write on the back on the grievances. And they always side with the guilty officer.

Also, a female guard or nurse has power. Especially in these little hick and country-ass towns, where they wish a muthafucka would get out of line. Don't matter what color you are. When they get thru beatin' you half to death, behind something some female said, you'll more than likely be beat blue. I've seen it at least fifty times. I even had a woman lie on me and say that I had threatened her physically, from behind two closed and locked doors. The warden looked at her like she was crazy and let me make it. I was just blessed to be in the presence of a warden who knows the game.

The article should have also talked about how we get charged $100 every year for medical, but they don't pay us for working or provide a way for us to work the $100 off. Also, we only get $50 when we leave, and $50 when we go report. If you discharge they give you a whole hundred. Wow! And the windbreakers they make us wear during the winter months, and have the nerve to call it a coat. They work you in winter weather with no thermal clothing, even though they have more than enough to issue out.

Damn man, talk about the shit that's really going on. The real shit. How muthafukas came in gangsta-and-guerrilla, but leaving out like ginger bread dolls. Yeah. And you all know who you are. You boys outta control down here in the great state of Texas.

MIM(Prisons) responds: There are a few points in this letter that need a response. First, we're not sure exactly what issue the author is taking with the original article in ULK where another prisoner wrote about how rats working for the prison were undermining his United Front work. It sounds like this prisoner thinks that's not important, but if we are going to fight these terrible conditions we need some unity, and building a United Front across organizations is critical to this battle. We can't just write about the problems without also talking about the solutions, or organizing successes and failures, and how to build from there.

The point this writer raises about female prison staff is a good demonstration of the gender oppression that happens in prison, that is very different from what goes on on the streets. While biological men generally have gender privilege relative to biological wimmin in Amerika, there are some differences by nationality and also within prison. In the prison situation, where most prisoners are men, female prison workers can accuse those men of sexual misconduct and get them beat or punished, without having to provide any proof. Further, numbers from the Bureau of Justice Statistics demonstrate this power difference: "Significantly, most perpetrators of staff sexual misconduct were female and most victims were male: among male victims of staff sexual misconduct, 69% of prisoners and 64% of jail inmates reported sexual activity with female staff."(1) Overall MIM(Prisons) sees gender privilege as the norm for both men and wimmin in the First World, relative to both men and wimmin in the Third World. But the abuse in prisons should not be ignored.

On 8/13/2013 an offender who has severe breathing problems was pepper sprayed in the face. I am sorry to say it took his life. On 8/14/2013 on A3 in an isolation cell an offender had his hand in the door where the hinges are. A guard, Mr. Wright, closed the door on his hand, cutting it and breaking bones. I asked Mr. Wright about it and he said he did not do it out of malicious intent. I was working as SSI all day and had to clean up all the blood that was in the cell. A Sergeant came and told Mr. Wright that he should be careful what he says in his report, and ripped it up, and all morning the Sergeant helped him cover up the incident.

From around 8am to 2:30pm I was out cleaning pod. I cleaned isolation cells at 8am and again around 2pm on 8/14/2013. I heard them talk about it all morning. They disrespect us, harm us, and when they do something to us they high five each other. Their actions to fib on reports are backed up by each other. How to ever catch them to tell the truth is a major problem.

I am at a unit that violates multiple policies of its own. It hides its actions and harms us in many ways. I started looking into the rules and I am really not surprised at what I found. I have seen them handcuff and beat one prisoner and they later on pepper sprayed another for having his jacket on at pill call. I have filed multiple grievances and have received no answer. We can't defend ourselves at all without double punishment due to the guards being one solid group that high five each other after they beat us down. They do such mean things to us and get away with it. These officials go out of their way to do mean things to us. We are held in isolation for months even years even though we have not broken any rules. How far must we bend before we get help from outside?

One mailroom worker made sexual advances and I knew it was a setup so I filed a grievance and sent a statement to the warden. A captain came and I refused to be forced to write a statement for him so I wrote him up. On the grievance response it stated that my verbal statement was different than my written statement. But I gave no verbal statement. The grievance investigator did not even investigate.

MIM(Prisons) responds: This prisoner is right that catching the guards and exposing the truth is a major problem. This is part of the important role played by Under Lock & Key: providing a forum to expose guard brutality and abuse. By documenting these incidents we can show that they are not just individual cases, but a systematic part of the criminal injustice system, and something that we must fight as a whole. To help fight the grievance system, which denies prisoner's an avenue to appeal injustice and guard abuse, get involved in our campaign to demand grievances be addressed. There is already a petition for Texas, and petitions exist for many other states as well. If we don't have a petition for your state we can send you a generic petition which you can customize for your state.

Recently a report was released by the U.$. Department of Justice - Civil Rights Division. The report concerned a survey conducted relating to sexual assaults and abuse taking place in Amerikan prisons and jails. The state of Texas was at the very top in terms of sexual assaults and abuse reported by prisoners. In fact, the Bill Clements unit located in Amarillo, Texas and the Mark Stiles unit located in Beaumont, Texas rated high in prison rape cases as well as sexual assaults. There has been no evidence to suggest the Texas Department of Criminal Justice is overly concerned about the persynal welfare and safety of the humyn beings held captive in their modern day gulags. Recent evidence shows the blatant disregard for humyn life in Texas prisons.

In Kennedy, Texas where the Connally Unit is located. A drought has caused 2 of the 10 water wells servicing the area to dry up. In a sign of extreme stupidity the warden of Connally Unit offered the water wells servicing the prison to the civilian population in Kennedy!

Some viewed this as an admirable gesture of good will. Although no one stopped to think about the prisoners housed at Connally. In Mid-August there have been reports of no-showers, no-toilet flushes, no-water being offered to prisoners on the unit. What the hell was the warden thinking? That's the point comrades, the oppressors down here don't think. A prisoner in Texas is less than humyn, a barn animal, cattle, chattel, dog or cat but far from being viewed as humyn.

This is why political and legal education is so very important for the lumpen underclass housed in Texas state prison. We cannot organize against these oppressors if we don't embrace the stage we are in. Cutting edge revolutionary scientific analysis tells us we are at the stage of A) Educate B) Raise awareness and consciousness and C) Garner public support for our struggle!

If the U.$. Department of Justice knows Texas allows the abuse of prisoners, what do they intend to do about it? A fancy report doesn't do jack to solve the problem. We need tangible realistic solutions. We must lobby hard for these oppressors to be held accountable. This executive director Brad Livingston?! Out! This Prison Rape Elimnation Act Ombudsman Ralph Bales?! Out! This Warden on Connally Unit who has ignored the basic needs of the humyn beings in her/his care? Out! And add some civil rights violations and criminal charges to their resume and perchance they will take their job more seriously.

On June 29, 2013 a Black Texas Department of Criminal Justice Correctional officer with the last name Ford used his handcuffs on a Latino/Mexican prisoner as if the handcuffs were brass knuckles. Officer Ford punched the prisoner repeatedly in the head. Fellow prisoners who witnessed this heinous act requested to be given witness statements. Captain Vincent, Lieutenant Sutton, and Sergeant Landrum refused to produce witness statements. This is just one more incident adding to a long list of human rights abuses and violations that have taken place on the Estelle Unit located in Huntsville, Texas.

We have found through our experience that the Grievance Program is corrupt in Texas prisons. Nevertheless, in order to maintain a record of the incident and preserve the right to file 42 US 1983, total exhaustion of administrative remedies is a must per the corrupt PRLA law. I and many comrades in Texas and beyond have written the U.S. Department of Justice - Civil Rights Division - Special Litigation Section. I've gotten back the same form letter response over 6 times! They ain't doin' shit! The abuse continues.

Handcuffs being used as brass knuckles!!? Ranking supervisors refusing to pass witness statements!!? These are criminal acts. There is an ongoing conspiracy to cover up said illegal acts in Texas prisons.

I have discovered a "formula" that works very well in reference to combating these oppressors in Texas, especially when they band together in order to cover up blatant acts of abuse and humyn rights violations by TDCJ employees:

1. Media coverage - form bonds and relationship of trust and respect with journalists.
   
2. Prisoner rights activists - we all need free world helpers.
   
3. State and federal legislators - you must seek an authority higher than the prison administrators.

This 3 step formula is good for all states but the specifics will change by geographic location. However, at this time our focus is on Texas! Step 1s don't work, Step 2s are a joke. O.I.G.? Impotent. Executive Director Brad Livingston, Texas Board Chairman Oliver Bell, all T.D.C.J. offices and entities operate under the same program and that is cronyism, nepotism, obstruction of justice tactics and cover-ups.

Who is ordering TDCJ to downplay and coverup acts of abuse and barbaric acts of violence aimed at prisoners? Answer: Texas State Attorney General Gregg Abbott! He is at the top of the food chain and remember he is running for Governor in Texas. It is time for the Attorney General's office to be held accountable for all these heinous acts of violence being perpetrated by TDCJ employees with no accountability.

Comrades, all of this information is meaningless and useless if you do not test it - practice it! Let's consider a quote from our esteemed Comrade Fred Hampton: "You might say, 'well the way I feel, people ought to be able to walk around naked because rape is love.' That's idealism. See what I mean? You're dealing in metaphysics. You're dealing in subjectivity, because you're not testing it with objective reality. And what's really wrong is that you don't go test it. Because if you test it, you'll get objective. Because as soon as you walk out there (naked) a whole lot of objective reality will vamp down upon your ass and take whatever you have. So whenever this happens, this is when people get a whole lot of mistaken ideas. That's why a lot of you can't understand and can't agree with a lot of what we said. You've never tried it." He continues later saying "That's what the Black Panther Party deals with. We're not metaphysicians, we're not idealists, we're dialectical materialists. And we deal with what reality is, whether we like it or not."

The Reality

The reality in Texas prisons is we the lumpen underclass are being degraded, dehumanized, mistreated, and abused. The persons who are in positions to protect us from such abuses are turning a blind eye to our plight. We are being murdered, raped, and beaten by the very people who are being paid to provide safety. The only way to combat this is by shedding light on the Texas Department of Criminal Justice and the Attorney General's Office who is 100% culpable in regards to these crimes against humanity.

MIM(Prisons) is the tip of the spear. I am only one of many hands wielding the spear. I close with a quote from Chairman Mao: "Our point of departure is to serve the people whole-heartedly and never for a moment divorce ourselves form the masses, to proceed in all cases from the interests of the people." If we put as much time into this fight as we do on the domino table or the rec yard, change will come in Texas. The comrades in California are a stellar example of solidarity in action. As Eric B. and Rakim used to say "Follow the Leader!"

All Power to the People!

We've had a recent death here due to use of excessive force. We've been dealing with that, getting outside sources to reach out to and filing complaints on the inside. I've had only one response from outside: the Houston Police Department's internal affairs. They've told us that our complaint has been sent to the state Inspector General's office. I was told yesterday that 20 or so men who filed complaints have been given some sort of case for filing. I have to look into that.

Our close comrades have been busy coordinating weightlifting and basketball events. These events allow us to increase our profile and spread our message of unitary conduct. This also encourages others to adopt the principles which make us comrades. So, maintaining that as a sustained front has been a priority. This is how we are able to locate minds who are receptive to USW literature and who are prepared to come into greater degrees of organizing. We're finishing up our basketball season this week. We are signing up rosters for a soccer tournament which will begin next week. And we are beginning to coordinate our 3rd annual unit-wide collective fellowship meal, which has always been a powerful way of advocating for unity across ethnic and racial boundaries.

So, in addition to writing to you and four other outside groups united in our struggle, I need to, today, brief 5 other comrades who want to coordinate functions of their own under our banner. I mentor a young development of 2 others who are new to our collective. And I need to get at least 10 others some recent commentary to keep them in the loop. I absolutely need to delegate more. But even that is a process in itself in this environment.

While all of this is going on, I've had to mediate a situation where a young comrade had a conflict with a white guy. Because the white guy was so much bigger and older, Black families were upset. Because Blacks got involved and the white guy used to be associated, white families are upset. So, you try to keep the peace while pride and ego come into play. The whole time understanding the stakes involved, the potential for escalation, and knowing that the Mexicans are watching Triple C closely right now, judging how I conduct myself in the affair.

I realize always that lives are on the line. I do the work so that these men and their children can gain more power to determine their economic, political, and social condition. So much of that work involves meeting cats where they are at, and working to provide solutions to immediate needs; doing that while communicating one big picture, and while demonstrating methods of achieving evolved conditions of living.

MIM(Prisons) adds: This is a good example of the day-to-day ground work that revolutionaries engage in to build the movement against imperialism. While exercise, in and of itself, may appear unrelated to anti-imperialism, this is something that can be turned into a solidarity activity, especially in prison where even such basic activities are greatly restricted. We have reported on similar organizing in California prisons. This comrade is part of an organization that is in the United Front for Peace in Prisons which is focused on building peace and unity within the prison population. Wherever we can break down divisions between groups and build unity to fight our common oppressor we will contribute to a stronger anti-imperialist movement overall.
