Tossed in Segregation for Grievance

I have spent the last 60 days in the hole for writing an administrative remedy on the superintendent. He turns around and has me placed in segregation and charges me with an offense due to my political activism. I am what they call a trouble maker because I teach others with our knowledge. But that's what I do. I was taught by the old heads to do what I do.


MIM(Prisons) responds: This response to prisoner's fighting for their legal rights against repression is all too common. It is one of the driving forces behind our expanding campaign demanding grievances be addressed. Food Strike in North Carolina

I would like to notify you all that the comrades and myself (about 10 or 15 of us) are going on an indefinite food strike until our demands are met. It will begin on December 1 and the demands are based on conditions at the institution that are unequal to others, inhumane and macabre. Some of the major demands are:

  1. Being able to recreate (on exercise hour) without full restraints
  2. Removal of the metal covering from all segregation windows
  3. Placement of desk, chair and hygiene shelf back in the rooms
  4. Adequate food and full portions on food trays
  5. End of censorship, bans and/or dis-approvals of reading/study material which do not violate prison rules

Most of our demand are for segregated prisoners who suffer greatly in the facility. We have also organized a call-in and letter writing campaign on December 1 and after in response to these conditions we're fighting. Our parents, friends and comrades will be participating. We are learning from our Pelican Bay and Georgia comrades, even though our strike is on a smaller scale. We still need to learn from the experiences of our comrades to eliminate mistakes.

Fight Oppression at Scotland Correctional Institution

This is a cry out for help from the brothers in the struggle at the confinement of Scotland Correctional Institution located in Laurinburg, NC under the ruler and dictatorship of Karen Stanback, Asst. Superintendent of Security. It grieves my heart to know and witness an African American woman, apply rules of oppression to camp populated by 80% minority races. Actions of oppression ordered by K. Stanback are:

  1. To ban all Under Lock & Key publications
  2. No state or local newspapers
  3. No shirt jackets worn in the dinner hall, school, or any religious programs (no matter what the temp is)
  4. No showering from 6pm until 9pm (with a population of 1500 prisoners)
  5. No jobs for close custody prisoners once they lose their assigned job. (All jobs are then referred to medium custody prisoners)
  6. Confining over 145 prisoners in one unit called Green D,E,F or "Gangland". This is where all the gangs are housed at, mixed together, and not giving any opportunity for regular programs or employment like the regular population.
  7. Only 1 hour of recreation. Without proper exercise, fresh air, and movement an individual develops a mentality like a caged in animal.

    She and the admins here have created a very hostile environment and seem to enjoy it.

    Brothers and sisters please! This is our cry for relief the hammer of oppression being applied to us at Scotland CI under the watch of K. Stanback. Please contact the appropriate resources to aid us in our struggle.

Proof!: The State Lies in Order to Censor

On October 17 I received Under Lock & Key 22 even though I was not supposed to. It was a mistake made by an officer who was passing out mail. Attached to the publication was a notice to prisoners of statewide disapproval of the publication; this particular issue has been banned statewide. I was supposed to sign this notice to verify I've been informed but luckily the officer was distracted by his duty of distributing mail and instead of having me sign the notice attached to ULK 22, he just slid them both under my door.

When I realized what the notice was for, I grew kind of excited. The kind of excitement one has when you feel you just got over on someone in power. This made me even more interested in the ULK publication. First, because I'm thinking I'm the only one statewide who has one. And second I know this publication has material and information the state doesn't want me to know; why else would they ban it statewide?

Before I began to read the ULK, I read over the notice to find out exactly why this particular publication was banned. The notice said: "The publication/material violates Division of Prisons Policy at Section D.O 109 and is disapproved for the reason listed 'violence, disorder, insurrection or terrorist/gang activities against individuals, groups, organizations, the government or any of its institutions.'" With that my excitement grew even more, thinking I obtained material of such nature. The notice went on to say that this "violence, disorder, insurrection..." was on page 4 of the publication.

I immediately thumbed to page 4 and found the headline "Time for Peaceful Revolution" written boldly atop the article. I began to read. I was confused. I retrieved the Notice to Inmate of Statewide Disapproved Publication once again to make sure I read it correctly, and I had. I was so confused that I had to go over the article once more because maybe I misread!

I was confused by the reasons given for banning this material. It was banned because it was supposedly promoting violence, disorder and so forth against individuals, groups, organizations, the government or any of its institutions. But really, one hundred percent honest, the article was speaking of a peaceful revolution. In none of its lines through the article did it speak of violence against anyone. It spoke of unity amongst the many LOs and a little history of Kingism.

It was then that I really and truly realized the power we have amongst us if only we could just unite as one and struggle together. I realized it's not us as individuals who they are afraid of, it's we as a people who they fear. Why else would they ban an article speaking of a peaceful revolution and that urges others to come together as one? And also, it's not necessarily violence that they avoid, it's a revolution, period! It's not how we go about the revolution that frightens them, whether its violently or peacefully, it's simply the thought of a revolution, an end to their domination over us, that unsettles them.

And they will do what they have to do in order to maintain control, whether it's murder, imprison or, in our case, censor mail. If the officer hadn't mistakenly given me the ULK 22 I would have actually thought that maybe MIM(Prisons) was influencing violence. But now the truth is out and it has me in question about the other publications that were banned. Were they really banned because of the reason these prison administrators told you they were? I don't think so.

Our rights are being trashed! We must, I repeat, we must, stand up for our rights. Fight censorship!

Legal Mail at Scotland Opened

I am a prisoner at Scotland Correctional Institution in Laurinburg, North Carolina. I am writing to you because of the fact that the legal mail that you sent out to several prisoners here [containing a letter MIM(Prisons) sent to the Director of Prisons regarding ongoing censorship at Scotland CI] was opened by the mailroom staff and treated as regular mail.

Even though the mail had "Legal Mail" stamped on it, the mailroom staff still opened it. By DOC policy I have to witness them opening my legal mail, and I have to sign for legal mail. By them opening this legal mail, they violated DOC policy and broke Federal law.

This requires some sort of action. I am filing a grievance on this matter and when I receive a response I will send it to you.


MIM(Prisons) adds: This letter is just one example of the long history of mailroom staff at Scotland CI unjustly censoring, banning, and trashing mail from MIM(Prisons), with the collusion of Assistant Superintendent Karen Stanback. While this comrade is filing grievances and organizing other prisoners around the issue, another comrade in North Carolina is working on bringing a case against the NC DOC to hopefully reformat the whole censorship and grievance system. the Time to Act is Now

NAS told us "ghetto prisoners rise" and Bob Marley asked "How long shall they kill our prophets?" It's been going on for years, yet we have failed to grasp on to a sincere movement with righteous motives. When the Europeans landed here they drove off the inhabitants or enslaved them. Sounds familiar to the immigration issues of today. Then they enslaved over 10 million native Africans throughout the "new world." Sounds like the incarceration and slave laboring of the Black and Latino youth of today through prison industries.

Now they don't have to kill our prophets like Martin, Malcolm, and Hampton. They just imprison them on anything they can to stop a movement. Education is the key to unlock the doors that block us and communication is the keyring that holds it together. Ghetto prisoners rise, rise, rise, united we stand and divided we fall. When the CIA killed Ernesto "Che" Guevera, he exclaimed "go ahead, what are you waiting for, you will only kill a man." Meaning his purpose, and meaning for which he fights will still live on. If we stand idle we are with the oppressor. Nelson Mandela said "If you fail to help the oppressed you become the oppressor." Don't be my oppressor. Revolution starts with the mistreatment of people, not a revolutionary.

Their objective is to keep you deaf, dumb and blind. Ignorance is suicide, they run their agenda through propaganda, spreading rumors and lies through their media. Zach de la Rocha said "fear is your only god" but don't let fear put you in check. The time to act is now, unite. Fighting Back Works

I would like to comment on the story written by a Pennsylvania prisoner titled "Stand Up For Real Causes," printed in ULK 16. First let me say the situation you describe is all too common. Unfortunately, I'm currently a ward of the North Carolina department of corruptions and housed at Hoke Correctional Institution (aka Toke Correctional). My point is this, these cats here are the most passive dudes I ever jailed with. I'm from Jersey and unfortunately I spent 9 years and 9 months in prison in NJDOC and the shit I see go on here in NCDOC would not go down there. Like you, I've tried to get these so-called convicts to stand up for change and correct some of the unjust B.S. here at Hope Correctional.

On Feb 2, 2010 this unit changed custody levels from medium to minimum custody and to a medical institution with little modification. Unfortunately, I was one of the few prisoners who were allowed to witness the transition from medium to minimum custody, and I believed all the lies the administration told us. The first thing they told us was that we would be given transfers to other facilities which would grant us custody level promotions with the privileges of work release and home passes if we stayed and trained the new incoming prisoners on how to run the kitchen and occupied certain jobs until they could be filled. Well, lo and behold, we were tricked and suffer daily. Prior to the custody level change this facility held 260 prisoners and now they have us packed in like animals. Single cells were made to house two men in quarters designed for one. 24-men units are now 48-men units with only four shower heads and we are only allowed to shower from 3 pm to 9 pm.

I tried to get a few dudes to come together to file grievances on this issue but only three of us actually filed. The admin simply used an old memo by a former governor about a water drought which ended two years ago. We lost on that issue.

Since we changed over, the food service can't seem to order or cook enough food to feed the whole population. Every day the kitchen runs out of food. Every single day! Everyone complains and cries to each other but no one is willing to stand up for change. I went to the operation office and asked for 200 grievance forms and they gave me 300 without a question. I put myself out there once again and went to each block to hand out grievance forms about the food. When it was all said and done, only 8 grievances were filed and once again they counted on us not to unify.

There are many other examples I could express, but like I said, these prisoners are so passive, all they care about is being able to watch lame ass weekly TV shows. If they took the TVs in every day room these clowns would write the Governor.

What really gets me is I witnessed what unity can do in NJ state prison. I've seen tyrant Sergeants get reassigned. I've seen change come when we stand up and unite without violence.

Just a few months ago I wrote ULK about the pigs here waking us up every 30 minutes to assure we were alive, and not only did I write to MIM(Prisons), I also filed a grievance on this issue. My story was published in ULK July/Aug story titled "Sleep Deprivation to Control Oppressed. My efforts were not fruitless. As a result of my grievance and persistence this policy was changed and they no longer deprive us of sleep in GP or the lock up unit (H-Block). When this injustice occurred I advised everyone on the lockup block to join me to change this policy, but once again I was the only one who raised hell and even then the result was change, so I know it works.

Staff Assault Prisoner, Ignore Grievance

In August 2010, Sgt Lowry grabbed me from behind and started choking me. It is on video tape. I was in my cell and unit manager Covington had my cell door opened and lock-opened. He asked me to dress and exit my cell. I step out my cell door. I was then grabbed from behind and choked. They acted out of retaliation from two officers being in a confrontation with another convict earlier.

My case is a sure assault on a convict. I have witnesses, plus I wrote RN Barrett up for denying me medical attention. I finally received medical attention on August 20, eighteen days after the assault. I've been trying to receive further medical attention and medical has not made any attempts at scheduling or assisting me with my neck injury I sustained from being choked. The facility and the medical department at Scotland Correctional are working together against my claim of assault. I have written various letters to assist superintendent Stanback concerning this matter. I have not received step two from grievance even though I signed off on step 1 a month ago. No one is answering my paperwork.

My case is very strong against them. This is why they are avoiding me. Hoping I will get tired of writing or pursuing the issue. I just need the proper legal back-up. I would appreciate your advice or referral in this matter.


MIM(Prisons) responds: Unfortunately it is typical that prisoner's grievances are ignored by staff, especially when they directly accuse a staff person of wrong doing. For this reason we are working with USW comrades on a grievance campaign. We have petitions set up for several states and need prisoners to help expand this across the country. Assault with a sock?

I am currently on I-Con [lockdown] for assault on staff, but the write up was false. In December 2009 an officer was told to write me up for assault because I refused to sit down in the day room. She called me out by name and then told me to go to my bunk. As I was going to pass her she stood in my way so that she was blocking my path, and she said I pushed her. Prisoners later told me that while I was in segregation she stated I never touched her, and that she wrote me up because she had the authority to do so.

In June 2010 my room got searched while I was still on I-Con for the assault charge, and I got written up for another assault on staff charge as well as destruction of state property and disrespect. They charged me with assault because the officer told me to drop my socks outside of my trap door. So I dropped them out my door because I was following a direct order. Now it's four officers standing outside my door and this particular officer is standing right in front of my door when the sock falls on his foot. So he says that I threw a sock at him. Officers claim I "assaulted" him but one of them told me that you can't assault anybody with a sock and she never saw me assault anyone but she wrote a statement claiming I did.

Even if I did what they claim, the charge A-3 assault on staff is for "throwing objects that are likely to produce injury or by any other means hitting, kicking and pushing." A sock doesn't produce injury and they claimed it hit him in the leg. I've never known a sock to injure anyone. The only reason I was found guilty is because it was the word of two officers and a sergeant and I had no witness. But the evidence that I asked to be submitted was never submitted in my case. I'm currently appealing the charge.
