Under Lock & Key

In early December of last year a hunger strike was called at Ely State Prison, joined by at least 39 prisoners at the start and fluctuating over the following weeks. A prison advocacy group, Return Strong, represented the prisoners’ demands as follows:

1. End the continued and extended use of solitary confinement, lockdowns, modified lockdowns, and de facto solitary confinement.
2. End correctional abuse.
3. End group punishment and administrative abuse.
4. Address due process interference and violation in the grievance process.
5. Provide adequate and nutritious food.
6. Address health and safety concerns in all Nevada facilities and provide resolution status to them.

In response, the Nevada Department of Corrections (NDOC) ignored several of the demands, calling them “false,” (2) but addressed some of the concerns related to food and administrative handling of punishments. Lower-level sanctions that result in loss of privileges will now run concurrently instead of consecutively, and Aramark, the food vendor, is being questioned about the portion sizes. Even the head of the local prison guards union mentioned that they’d noticed the portions shrinking recently.(1) Aramark has faced repeated legal challenges regarding its poor food from prisons across the country (3), so the fact that it’s now squeezing portion sizes in Nevada doesn’t come as too much of a surprise.

Some of the more serious allegations NDOC ignored include food being stolen from prisoners by staff, the existence of no-camera “beat-up rooms,” collective punishment and indefinite 23-hour lockdowns excused by laying the blame on “staffing issues,” and the de facto suspension of programming for many prisoners.(4)

Prisoners at Ely State Prison voluntarily suspended the strike after four weeks and the adjustment of some of the handling of administrative sanctions were addressed.(5) We didn’t receive any info from inside or outside coordinators about how/why the strike ended, just that it did. If any of our readers can provide insight we’d appreciate it.

I began a Juneteenth protest in April on the 23rd. I went on hunger strike on the 28th, but broke it 2 days later to get my strength up after being threatened by Sergeant Couper.

19 May 2022 – I began a second hunger-strike for 8 days. On the 3rd day of the strike, I was taken to a dirty holding cell in receiving – with ants, no bunk, and poop caked up inside a broken toilet. I was only allowed a bible, one sheet, and one blanket. They placed the old raggy mattress on the floor where I was to sleep for the next 5 days.

No incoming or outgoing mail; no human contact; no offer of food; and no vital-signs, weight, or sugar was checked (nurses documented false reports). May 23rd, in medical, when the nurse asked why I wasn’t eating, I told them, “because it’s ‘George Floyd Day’, Get Your Knees Off Our Necks.”

26 May 2022 – I went on S.I.B. [self injury behavior watch] and was given an even worse mattress that smelled of feces. No one checked on me.

27 May 2022 – I was shipped to the Emergency Room at Central Prison. A level-one bone-marrow cancer had intensified the damage to my body. Some negotiations were made and I broke the fast. However, while I was on the IV a nurse came in at shift change and snatched the IV out of my arm and told me and my officers to get out.

One Month Earlier

April 23rd, I was attacked by Sgt Couper because I had asked for a roll of tissue (I had been asking for 24 hours). Sergeant Couper said he needed to search my room for tissues then pulled out his mace and tried to find an excuse to mace me. When I cuffed up he resorted to violence by snatching my arms all the way out the trap, then opened the door and threw me head-first into the back wall, then applied torture techniques, such as bending my fingers & choke holds, while tightening the restraints.

I was eventually taken to receiving and left on the floor with the restraints for 4 hours. I had lost feeling in my arms, wrists, and shoulders.

Sergeant Couper continues to harass and retaliate against us; intercepting grievance appeals and managing investigations for disciplinary reports that he has officers fabricate against us. But “We Reap What We Sow”. On 9 June 2022, he got served!

MIM(Prisons) adds: On 30 June 2022 there was a phone/email zap to Granville Correctional Institution to support the strikers and to call for an end to the physical abuse by Sergeant Couper. Staff responded by saying that Warden Roach was not in that day to take calls and that there was no physical abuse going on there. Emails to the Warden and Director of Operations were not responded to.

SIB Short Staff

There’s been a shortage of staff on super-max. One reason being too many prisoners are in S.I.B. (self injury behavior) watch and must be monitored. Once observation and receiving cells are filled to capacity then guards must (individually) sit outside the housing cells of any other prisoner on S.I.B.

Phone Zap

From experience in what may have been S. White’s 1st successful protest in 2019 Oct, outside support via phone zap was effective. All morning this tied up the prison’s phone line until the prison took the phone off the hook. The outside supporters then phone zapped Raleigh. So Raleigh called the prison asking why the phones were off the hook.

There was 9 to 16 comrades in the prison on hunger strike and multiple people on S.I.B. By lunch 5 comrades were called by Captain Henderson to receiving and asked what they wanted. All of us already had grievances being processed about other things. S. White also sent copies of an anonymous missive to the administration with the policies that were being breached.

Juneteenth

For the memorial celebration of the Juneteenth we are participating in the traditional fast (meal refusal) for breakfast and lunch; and 10-20 S.I.B.s.

At North Carolina’s HCAU we want phone calls (iPad), TV news (iPad), spider-free outside recreation cages built large enough for more than one person, more food, real hygiene, heater fixed for winter, sally-port swept and mopped at least once a month, lights off in the day time, and case workers and fee recommendations for release from HCON on or after the second 6 month term (infraction free). Feel free to add to the list (every grievance will differ reflecting the demands of each comrade).

We’ll like to have outside support phone zap at this institution. Write MIM to stay updated. We do not expect any assistance from any boot-licking reactionaries satisfied with the man and any conditions of solitary confinement. Shall your days be numbered.

On 28 December 2021, Hisham Abu Hawash of the Islamic Jihad Movement in Palestine has gained a victory against I$rael’s counter-revolutionary “administrative detention” policy. Hawash’s lawyer, Jawad Boulos, has stated that I$rael pledged for Hawsah’s release on 26 February 2022 and therefore the hunger strike will end.(1)

Hawsah is a 40-year-old father of 5 and a member of the Islamic Jihad Movement in Palestine. He is among several Palestinian revolutionaries waging a hunger strike in protest of I$rael’s unjust policy, which locks up Palestinians without any due trial. He has faced 8 years of time imprisoned with 4 of those years under administrative detention.(2)

The Islamic Jihad Movement in Palestine (PIJ) rightfully threatened counter-attacks if Hawsah ever died in custody.(3)

Palestinians across the occupied land have gone in protests supporting the strikers. One protest in the West Bank city of Ramallah, on 6 January 2022, included signs which read: “Those starving behind bars feed the universe with dignity” – a slogan we extend to hunger strikers not only in Palestine but across the world.(4)

The Reactionary Policy of Administrative Detention

Administrative detention is a form of arrest or imprisonment done without trial – usually for issues of “terrorism” or rebellion. Many imperialist countries use the tactic of administrative detention to control unruly populations/groups.(5) In the United $tates for example, around 182,869 migrants from the Third World were held in detention centers through this method in 2020.(6) Despite the more advanced and developed contradictions between I$rael and Palestine, compared to oppressed nations in the United $tates and Euro-Amerika the year after, I$rael held a mere 1,595 Palestinians in administrative detentions. Amerika has truly earned the title “Big Satan” in contrast to I$rael’s “Little Satan” status on this front.(7) The administrative detention policy of the I$raelis work through the arrest and detention of Palestinian revolutionaries and activists. The idealists arguing for I$rael will say that administrative detention has been applied to I$raelis as well – notably, against ultra-chauvinist zionist terrorists and unruly settlers. Throughout the years, only 9 I$raelis were held in administrative detention; Palestinians and Arabs number in the thousands.(8) Any sober minded person and materialist will be able to recognize that the exception proves the rule in this case like so many often times.

Revolutionary salutations to all Texas USW comrades, leaders, supporters, and those reading this wonderful newspaper for the first time. In issue #75 there was some dialogue regarding the BP 3.91 and i would like to speak to some things.

Comrades, as you all read in the last issue, Allred RHU went on hunger strike in protest not only against B.P.-3.91, but also the illegal use of solitary confinement as practiced via RHU, and we also fought for other pressing issues. Due to this action, on September 8th i was pulled off the outside rec yard, and brought to a cage; this cage is very similar to the one illustrated by the comrade in the last issue. Me and another New Afrikan brother were the only two of all the strikers who went through this. After standing in the cage for about 30 mins to an hour I was informed by an inmate worker that “they takin all yo shit.” By this i assumed he meant food/beverage items of which i only possessed empty condiment bottles so I had no worries. Half an hour later, the property officer and a lieutenant come to escort me. They tell me i will have to send property, particularly books, home; i have too many and they may not be given to another prisoner. As they say this i have heated words with the property officer, and have to be escorted by a major and some others. They bring me to the office and outside my property (all of it including state property) is slung everywhere. I’m irate to say the least.

It is at that time that i entered an office with regional director David Blackwell, along with three unit wardens. Here is a brief overview of what was said pertaining to the B.P.-3.91 policy.

So this policy was supposedly pushed for by these “family groups”. He mentioned Texas Inmate Families Association(TIFA) as the main culprit. Supposedly one of the TIFA members has a brother who’s a sex offender(S.O.), and she learned that he was allowed to write pen pals who sent her brother sexually charged letters. Further investigation led the sister in question to observe that he could also view/receive pictures of women as long as the female wasn’t showing her “parts”. This woman was immediately concerned that her brother was not being allowed the proper environment to rehabilitate his behavior, and this is what led to the rule change.

In case you don’t know, every week, like clock work, TIFA and other family groups like the Families for Air Conditioning in TDCJ, have phone/zoom conferences with the executive director and other top personnel. In these conferences these groups are having influence on policy changes and other things that affect us here in prison. The issue is that these groups are not in contact with the masses, which in this case is US, the captives. TIFA has a $25 membership fee yearly, and imprisoned people can join. However, imprisoned voices are a minority, and are/will be over rode by the petty-bourgeois/labor aristocrat elements which dominate this terrain and don’t allow prisoners to practice any level of self-determination. Even worse is that these groups (TIFA in particular) do not even reply to inquiries from prisoners. The pigs mentioned above provided me with their info to contact and begin dialogue. I’ve wrote, I’ve e-mailed, I’ve DM’d, and have gotten no response. This is on trend as we of TX TEAM ONE have repeatedly contacted them in the past during our previous 3 hunger strikes in the last 4 years, not including this year’s. Never have we received any reply. So what does this tell us?

It tells us that the class divide is very profound in the TX prison movement, even on the “left”. It tells us that at this present juncture we can not collaborate with such reformers in any concrete way. Our movement MUST be prisoner-led.

Speaking specifically to the BP-3.91 issue, from observation one can see that these pigs are picking and choosing when/where to enforce this rule. THE RULE DID PASS! Initially we were told that it hadn’t, that’s not the case. Not only did this Director tell us so, but as i scribe this, Allred Unit has been under rolling lock down and the pigs (from what We in RHU are being told) are solely focused on pics, mags, etc. We in RHU haven’t been hit yet. Last week the ACA came to the unit. An audit. The pigs were verbally reprimanded (the wardens were) by ACA personnel for even operating the lockdown/shake down while they are/were still supposed to be under COVID protocol. This is a violation of CDC guidelines, which is one of the things we called attention to during the strike. The ACA demanded the wardens to cease the shake down. They did so for the week the ACA was here, yet today (9 November 2021) We’ve heard that they’ve resumed on the ECB building, and are to be coming here next. U.S. weekly and Cosmopolitan have been denied here.

The legal standing they’re trying to stand on with this move is that if they were to target specifically sex offenders with this rule while not applying it to the masses of the prison population who are not S.O.s then they open themselves up for suit by the S.O.s for discrimination. What it boils down to is We’re gonna have to come together and fight this through litigation. Simple.

It is not uncommon knowledge; given you have internet access; that the South-Eastern Correctional Center (herein after referred to as ‘South-Eastern’ Plantation or SECC) is by far a reflection of the “Survival of the Fittest”, mentality; (distorted interpretation of Charles Darwin’s theory dubbed ‘Social Darwinism’) that the fascist pigs who run this country maintain, and it’s core beliefs was founded upon. Theodore Roosevelt in the preface to Vernon Kellogs, a German intellectual, book “Headquarters Night”, stated that “The man who reads Kellog’s sketch and yet fails to see why we are at war, and why we must accept no peace save that of overwhelming victory; is neither a good American nor a true lover of mankind”. Remind you, this is a book where Vernon Kellog states “The creed of the Allmacht of a natural selection based on violent and fatal competition is the gospel of the German intellectuals; all else is illusion and anathema”. Scary to think that our President at the time shared the same core beliefs that kindled the Holocaust!! Individual self-seeking in hopes to promote the good of society only breeds contempt and enmity amongst social-classes by separating that which is “We the people” into “they the people”, “We a people”, “There’s some more people”.

Staff-on-Inmate to Inmate-on-Staff ratio for assaults is mind-boggling. In a last minute attempt, due to a 5 min riot in February where 3-7 C/Os were hospitalized, one in critical condition and one in a coma, SECC and Plantation Master Bill Stange issued sham pretext investigations on over 67% of the facility to target, arbitrarily and artfully punish offenders who the administration has a certain disliking for. Individuals who were in no way shape or form involved in said riot; in order to obtain order and security of the facility, more commonly known and acknowledged as oppression and submission of the offender population. On top of violating Constitutional rights, protected liberty interests, and adhering to corporal punishments, the South-Eastern Plantation in retaliatory effort has cut the camp population by over 50% and have re-administered long-term Administrative Segregation confinement(Ad-Seg). Two individuals have killed themselves this year, and 5 different hunger strikes have been done, in an attempt to obtain that which is our Constitutional right(s). The struggle against Ad-Seg isolation here continues.

The inhumane conditions, injustice, and complete disregard for policy and federal law here at the South-Eastern Plantation is amongst the worst in the state of “Misery”(MO). Particularly those who work here at the South-Eastern Plantation; with the blatant approval or blind-eye of Jeff Norman, Anne Precythe, Alana Boyles (Directors of MDOC); pigs here have taken to various different modes of divide and conquer tactics as a stratagem to warfare. One particular incident occurred on November 2nd, 2021 when COI PIG Ms. Reed rolled an offenders door without cuffing him upon request, and stepped aside so in the Ad-Seg. Unit he could stab a cuffed offender exiting from the shower. PIG Ms. Reed then directly thereafter allowed retaliation of another offender who too was handcuffed and shackled to the door. She is now on investigation along with the COI PIG Hood who before payed for an LGBTQIA+ trans woman to be assaulted by another offender.

Minimized food rations, one state bar of soap a week in Seg, rec once a week, mice infested houses, free cases and beatings; SECC is in need of some serious outside attention. Us comrades here continue to fight Capitalism-Imperialism with our dying breath. We will not stop until we bring conscious awareness of the proletarian state and the science of Marxism-Leninism-Maoism. We seek a world without chains, slavery, and oppression.

The Escape

On 6 September 2021, 6 Palestinian prisoners of war have escaped an I$raeli maximum security prison known as Gilboa by digging a tunnel with plates and panhandles.(1) The tunnel was 72 meters long, and the I$raeli Security Agency has suspected that the excavation had started around November of 2020.(2) This incident is being talked of as the most significant prison break in the history of Palestine.

The 6 Palestinian prisoners were members of Palestinian nationalist organizations (The al-Aqsa Martyrs Brigades and the al-Quds Brigades) which have resisted the I$raeli occupation.(3) Out of the 6, four of the escaped freedom fighters were serving life sentences.(4)

In response to the prison break, the I$raeli Prison Service (IPS), launched a lockdown on Palestinian prisoners: break time has been cut to one hour a day; prison canteen has been closed; and the number of captives able to walk in the yard has been decreased. 400 prisoners, who have been deemed “Jihadist” and a threat to the security of the prisons, have been separated from one another as well. On top of this, family visits have been completely taken away by the pigs.(5) For our readers on the inside, these tactics by the I$raeli prison pigs to punish all for the actions of some sound similar as the United $tates and I$rael are very similar in character. Both are settler-colonial states, and both trade and exchange tactics/information used to better repress their respective oppressed nations.

The Day of Rage

In response to this crackdown, I$raeli prisons faced strikes and riots. In Katziot prison, seven cells were set on fire by Palestinian prisoners and hunger strikes have been set to begin in Gilboa on Friday, 17 Septemebr 2021.(6) The Palestinian Prisoners Affairs Commission has declared that 1,380 prisoners have joined the hunger strikes.(7)

Outside of the prison walls, the nationalist organization Hamas has declared a “Day of Rage” on the Friday of September 10th.(8) At the al-Aqsa mosque, supporters of the escaped freedom fighters have organized a sit in protest after the end of prayer. The I$raeli forces stormed the mosque in response to the protest and killed one man and arrested another. The man killed was a Palestinian doctor named Hazem al-Jolani.(9)

About a week after the escape, the 6 prisoners were recaptured into imprisonment. One of the freedom fighters, Yaqoub Mahmoud Qadri, was put in solitary confinement with nothing but a blanket and was subjected to physical and psychological torture.(10) All other prisoners involved in the escape were sent to separate high security prisons as well.(11)

Internationalism in the Prison Movement

While studying Engels’ writings on the bourgeois state, Lenin said the following:

“Engels elucidates the concept of the ‘power’ which is called the state, a power which arose from society but places itself above it and alienates itself more and more from it. What does this power mainly consist of? It consists of special bodies of armed men having prisons, etc., at their command.”(12)

As Lenin explains, prisons serve a class purpose in maintaining power in class society. In the world we live in today, the bourgeois class utilizes prisons to control their “unruly” populations under their command. Under socialism and proletarian dictatorship, prisons will exist as well (albeit under principles of rectification and rehabilitation learned from the past socialist experiences rather than punishment for punishment’s sake). For the case of not only the 6 prisoners of war who escaped Gilboa, but also for all prisoners in Palestine and all prisoners in the United $tates, their facilities are a material form of capitalist-imperialist power locking them up in their every move. Here in the United $tates, we have had historic moments of prisoners fighting against the repression and seeking for redemption and liberation through class struggle. The Attica uprising of 9 September 1971 is a prime example of that class struggle. With Attica as the battle cry of the revolutionary prison movement in the United $tates, we hope to reach that cry across the oceans and to Palestine itself.

On 15 September 2021 twenty four prisoners declared hunger strike at Foothills Correctional Institution in North Carolina. By 2PM the administration locked up 3 comrades. Me and another comrade stayed fasting.

They only give us phone once a week; no yard in a month; and less than 2 hours of recreation per day. Basically we’re in segregation for no reason. I reflect on these b.s. measures, then I asked myself why and how does this opre$$ion end?!

“Why are the battles endless?! Why the Us vs. them?! Why is the Earth CRYING ?!”

The American reformers who first devised the penitentiary believed that criminals could be ‘reformed’ through solitary confinement, labor and religious indoctrination. The use of solitary confinement and isolation/sensory deprivation began at Philadelphia’s Eastern State Penitentiary in the 1820’s. But what was actually discovered was that conditions of sensory deprivation caused mental deterioration and psychosis. Leading writers such as Charles Dickens and Charles Darwin, upon touring the penitentiary, spoke out against its conditions of mental torture. As Dickens observed: ‘I hold this slow and daily tampering with the mysteries of the brain to be immeasurably worse than any torture of the body.’ The Supreme Court ultimately ruled such solitary confinement ‘mentally destructive’ and outlawed it. It stated,

“A considerable number of prisoners fell, after even a short confinement, into a semi-fatuous condition, from which it was next to impossible to remove them, and others became violently insane; others still committed suicide, while those who stood the ordeal better were generally not reformed, and in most cases did not recover sufficient mental activity to be of sufficient service to the community.” See: In re Medley, 134 U.S. 160, 168 (1890)

Since that time, however, solitary hasn’t ceased. This is even after courts and legislators in the late 20th and early 21st centuries have outlawed even the new and more scientifically designed forms of solitary confinement.

TX T.E.A.M.O.N.E. was founded by persyns who have endured years and decades of solitary confinement in the forms of SHU and Ad-Seg (now called ‘restrictive housing’).

Many modern courts have found the same conditions and injuries to prisoners from confinement in modern control units as did the high court of 1890 in the Medley case (see: e.g. Madrid v. Gomez, 889 F. Supp. 1146 (N.D. Cal. 1995) )

“Many, if not most inmates in SHU experience some degree of psychological trauma in relation to their extreme social isolation and the severely restricted environmental stimulation in SHU.” This court concluded that confinement under such conditions may press the outer boundaries of what humans can psychologically tolerate. The psychological consequences of living in these units for long periods of time are predictably destructive, and the potential for these psychological stressors to precipitate various forms of psychopathology is clear cut. "Another court found that isolating human beings year after year or even month after month can cause substantial psychological damage, even if the isolation is not total. Davenport v. DeRoberts, 844F,2d 1310, 1316 (1999)

As a study on sensory deprivation by a team of 4 Harvard psychologists conducted for the CIA revealed:

1. The deprivation of sensory stimuli induces stress;
2. The stress becomes unbearable for most subjects;
3. The subject has a growing need for physical and social stimuli, and;
4. Some subjects progressively lose touch with reality, focus inwardly, and produce delusions, hallucinations and other psychological effects.

“Segregation is the modern form of solitary confinement. Segregation inmates are almost completely deprived of the commonplace incidents and routines of prison life. In theory [RHU] is not punitive. In practice, it can only be described as punishing.”

It is with the preceding information that TX T.E.A.M.O.N.E. has been inspired to put Our lives on the line in the most literal sense, by refusing the necessary nutrients for survival, and good health. This coming Black August 21st, the 50th anniversary of the assassination of George L. Jackson, TX T.E.A.M.O.N.E. will be leading the masses on TDCJ’s Allred Unit in a hunger strike to protest and bring attention to the fundamental injustice that is embodied in the mere use of isolation solitary confinement. We ask the inside community to join us in struggle, as We already have a case in the courts challenging TDCJ’s use of the RHU. We ask the outside community to join us in solidarity (solidarity actions will be listed at the end of this pamphlet).

What is BP – 3.91?

Board policy 3.91 has recently been revised and is set to take effect on August 1st. These revisions seek to create an asexual environment in prison. If the penal system has its way, all publications, pictures which may possibly cause arousal will be considered contraband.

While We, T.E.A.M.O.N.E., recognize the needs of some to rehabilitate themselves from what may be considered perverse sexual behavior, the same cannot be said for all, nor even most, prison captives. For factually speaking, each individual has individual needs to the realm of recovery and redemption.

TDCJ, when it benefits their agenda, seems to agree. For, in recent years they have mandated that each captive complete an ‘individualized treatment plan.’ All captive persyns must complete the plan prior to their release on parole, or risk remaining in prison.

What Penological Reason Does BP – 3.91 Serve?

At the date of this writing TDCJ has refused to state any reasoning for this policy amendment. This refusal in itself is unlawful, by the standard set by the Supreme Court’s Turner case.

That aside, since they’ve left the reasoning up to interpretation, let’s interpret it:

Why on earth would anyone want an asexual environment? One where in theory only sexual desire doesn’t exist? We say in theory only because factually speaking, no matter the variations of sexual expression, desire and arousal are as natural as breathing. What then happens when large masses of people are warehoused, cut off from ALL social stimuli, as We are in RHU? Frankly, this act falls in line with historical missions of the american establishment, in terms of genocide, a slow and deliberate de-population of outcasted sectors.

REMEMBER EUGENICS? The selective breeding of persyns in order to weed out unwanted social characteristics that were thought to be found in ones genetics. REMEMBER FORCED STERILIATION of both wimmin and men who were largely held captive, were mentally unequipped, or otherwise considered a liability to the social order. This BP – 3.91 is aligned with this grim history.

But that’s not all! BP – 3.91 will ban any material which depicts a persyn with their face covered! Still in the middle of a pandemic! Enough said!?

Phone-zap: Those outside persyns who’re not local should call the TX Board of Criminal Justice on August 1st (512-475-3250) demanding BP 3.91 be annulled as it has been revised, as it is an unlawful use of prison censorship.

On August 24th, supporters should call the executive director of TDCJ (936-437-2101). On the 24th We will have been on strike for 3 days, which makes it official. Demand that TDCJ begin to rectify its inhumane confining of RHU inmates indefinitely and without meaningful review. Express your support for the hunger strikers on Allred.
