Bill Clements Unit - Federal

I wanted to reach out to you and list what is (or is not) happening in Ad Seg (Administration Segregation) at the Bill Clements Unit in Amarillo, TX. As of 1 February 2024 the entire staff and rank has not only stopped doing everything but the response I get from both line bosses and Nigerian rank is “Fuck You”, “we don’t have to do anything we don’t want to do, and nobody is gonna make us.”

I suppose the best way to explain the horrific conditions here is to make a list:

Recreation: Per Federal law and TDCJ policy we are allowed 1 hr out of cell everyday. In 2021, we went to rec 4 times. 3 times in 2023. And now they stopped running all rec. claiming short of staff for 4 straight years, while uniformed employees are everywhere unassigned on overtime. Smart off to one of them over an allergy on tray and watch as up to 9 sergeants respond in under 60 seconds on a building of less than 500. But they can’t run rec.

Kitchen: We have eaten the same exact tray for a year now. Everyday, with exception of Johnnys, we tray with a tiny fish square or burrito. 400+ trays of a watered down tiny portion of ground “meat” and spoiled beans. In increments they stair-stepped down our portion sizes, along with not running commissary, our stomachs shrunk resulting in severe weight loss. My arms, legs and butt are without meat. When I came to Ad Seg I had muscles. Severe starvation, lack of nutrition and exercise stole that from me. Along with other body parts. Hair and finger/toenails no longer grow like they did with proper nutrition. Kitchen food is served cold after sitting out for hours and handled by staff with no gloves. Out of juice 1/3 of the time. Dirty food carriers never washed.

Barbers: 1 haircut in over 3 years. Barbers on pod once. Period. No haircuts.

Commissary: Stopped running period. Started by skipping us, manipulating spend cycles. Then always a reduced spend on only stamps no electrolytes. Now we went 1 of 3 spend cycles or once every 6 weeks in 2023, but they no longer run commissary period. Said the computer is down for months. Excuses, always. Responses are, one, that it is not their department and 2, that they don’t care. Quote Major Miles who said, “I don’t care”, when I pointed out to him that is why his building is fucked up and his subordinates under his “supervision” refuse to work. So we have no food. No kitchen food or commissary. Think what you want but I have eaten paper on occasion when hunger pangs get too severe. When we go to commissary there are only expired items. Out of stock list adjusts so we are forced to use an entire spend to purchase expired items.

Rank: Rank does not make regular rounds. Any request for rank results in a “no.” They refuse to call rank.

Maintenance: I had a leak and a wet floor for 9 months. Toilet didn’t work and sewage backed up in the cell. Not always my own. I had to poop in chip bags and pee in water bottles, which Major Pacheco instructed. They stole my electronics and over $100 in food with receipts. I grieved that. Grievance asked for extension and later said no grievance was filed. I listed witnesses. All 3 witnesses were put on chain to other units. Cameras also show it and Sergeant Durant and Major Miller but no one will replace stolen electronics and commissary food taken without any confiscation slips. Went a year with no light bulbs in dark cells.

Shakedowns: Excessive cell searches. We went through 8 full blown entire building shakedowns in 2023. All rigorous and excessive trashing our cells, stealing with no confiscation papers and lies on some.

Fake drug tests: Shakedowns and cell searched produced nothing. However, they hit us with fake pee cups that many or most failed even though they don’t do drugs and the drugs they supposedly popped aren’t even on this unit. Lab returned passing results on those who follow-up on appeal but by the time they overturn the decision you are already served “punishment.”

Mattresses/laundry: 2 years I was on waiting list for a mattress. For 3 years I have properly requested a clean blanket exchange – denied. During our 8 lock-downs and other various lock-downs laundry only does socks and boxers 2 or 3 times per week. Often same jumps for 6 weeks.

Temperature in cells: Not thermostat controlled. Extreme, and I mean extreme hot and cold. No in between. 8’x12’ cells have 12”x12” square vents forcing hot or cold air. The air flow does not cycle on and off. Blows like arctic blast or like oven at all times. No comfort ever.

Blood: Blood is collected daily. Every day. This is one of the only things they do routinely. Why?

Looking at the incarcerated world around us, it is no wonder the numbers of New Afrikan and other darker hued people who are captive is so high. It is no wonder why the level of illiteracy is most highly concentrated among the incarcerated. It is no wonder the level of schooling is low among the captive population. It is no wonder why there is more money invested in mental health services behind bars than in free world facilities.(1)

All this means that when we imagine our resistance against prison systems we must see prison as being more than just the place where people who commit crimes are sent. We have to begin to analyze the interconnected and multi-layered oppression within prison.

A key feature in warfare is physical violence. In prison, “official” physical violence is documented as use of force. The most use of force and most excessive use of force in Texas takes place at Bill Clements, specifically amongst its PAMIO program participants. PAMIO, for those who do not know, is a psychiatric program designed for those in Ad-Seg.

If you follow the logic, Texas residents with psychiatric illness are more likely to be held captive by the state, while in captivity they have a greater chance to be held in Administrative segregation (Ad-Seg). While in Ad-Seg their psychiatric state is likely to deteriorate and they are likely to face “official” physical violence at the hands of their captors at greater numbers than those without documented psychiatric history.

Conditions At Clements

Our situation at Bill Clements Unit Ad-Seg or ECB, Extended Cell Block they call it, has not improved. Although less deaths we are seeing a rise in starvation, torture, neglect, and unsupervised migrant workers running the prison as they see fit with little to no training. Regardless of what administration says. These Africans on this unit have not been taught day rules, standard operating procedures, and have zero regard for this so called rule book. And why shouldn’t they when there is no enforcement and or reprimand on the side of TDCJ.

During the last shakedown, a state-wide attempt to catch contraband, they had me in a cage outdoors for 2 hours while they tossed my cell. Guards and inmates watched me in handcuffs while Major Pacheo instructed Field Boss Shrader to steal all my electronics and commissary food items – over 200 dollars worth. All this I believe is because my toilet hasn’t worked for months and I keep requesting maintenance but it never comes. Same with the broken shower and the water leak resulting in a wet floor. I have receipts for all the electronics and commissary items they stole, and I listed all this and the witnesses on grievance – they put the witnesses on chain! Nobody goes on chain unless it’s to Montford Psych or hospital.

The second week of December we were allowed to shop commissary, the second time in 4 months. Breakfast chow consisted of two tablespoons of scrambled eggs with a quarter inch of grits and applesauce. In total it was 4 spoons of food. For lunch and dinner we had a cheese sandwich. They back-doored commissary with a shakedown and stole what we purchased.

I was allowed 1 hour out of my cell twice this year. The “weekly” library ran 9 times. Average time to see a mental health professional is 9-12 months. Delivered mail can sit in the mail room for over 6 months. They are understaffed and don’t have enough people to properly run the facility. Once they tried to put some beef on dough and call it pizza, it was not cooked and the meat was bad. Raw dough and spoiled meat. No shit. No exaggeration.

Not feeding us is not only to starve us but to keep us from relaxing. We are constantly fasting involuntarily. The hunger keeps us anxious and irritable, to put it mildly. In my pod of 60 I have seen 12 people lifted out on stretchers this year, nobody checking for a pulse or performing CPR. That’s 1 per month on average. This cell is worse than the third world POW camps I visited during my time in the USMC. The corruption is so bad with so many hands in the cookie jar that one cannot even get a judge to hear them out about violations. TDCJ just ignores our requests and cites their lack of staff as to why they have nobody to process the documents.

War in Ferguson

On November 16th all the interconnected elements of prison war worked together on the Ferguson unit as five officers, unprovoked and without cause, entered the cell of two men demanding they submit to a complete strip search and handcuffs. When one of the captives asked why, he was immediately hit in his face with closed fist by CIT Gates while SGT Vasquez grabbed the captive’s head and slammed it against the concrete wall, causing injury. The captive fell to the ground and was kicked, his head was banged against the floor repeatedly. Afterwards he was dragged to the run, outside of the cell, where he was continuously kicked in his face and was even stood on. The entire time other captives were yelling in protest for the guards to stop, but they refused. While on another row, but hearing what was happening, I began launching projectiles from my cell. Eventually this caused the guards to cease their beating. They escorted the beaten man away, then returned minutes later to handcuff and escort me.

I was housed in solitary two cells down from the victim. I had the opportunity to speak with him for the first time, find out first hand what took place. He also shared with me his history of intellectual disabilities, and mild history of psychiatric illness. He had been adopted at a young age and raised in the foster care system. Our time near each other came to a close after the pressures of solitary confinement pushed this brother to attempt suicide. Days later as a result of this incident I was notified by the Ferguson Unit Warden Wheat that I would be reassigned to Administrative Segregation, under trumped up charges of assault on staff with a weapon.

Attempts to appeal the reassignment to Ad-Seg have been hampered by Unit Grievance Officer D. Turner not allowing my appeal of classification to go through.

I have personally reported the unprovoked excessive assaults these same clique of guards have taken part in in the five months I’ve been on Ferguson. There is a culture of unmitigated brutality here and the slightest show of counter-force is excessively punished. Warden Wheat has been made aware of this clique of pigs constantly assaulting people without cause, he has ignored or punished reporters.

Prison is War. Prison is Violence. Administrative Segregation is the highest form of it, where prisoncrats are allowed to hide you and abuse you away from any and all scrutiny. A tool that is used to throw away resisters in the prison battlefield. End RHU!

On 6 September 2023 the Texas Department of Criminal Justice (TDCJ) prison system mandated a statewide Lockdown due to the number of deaths related to drugs: a total of 16. They think that will stop the flow of drugs, but you and I know that it will not. You and I know that as long as you have officers that are willing, it will continue.

…Most here are having to do all of their sentence, and some have said fuck it, I will continue to get high. They don’t have to worry about going to jail, cause they are already in jail. But it seems to be that the only ones making parole are the ones that consistently stay high. Do you think that if more were making parole that would cut down on some of the drugs being used?

Choper reports from Bill Clements on the same day: The Bill Clements Unit has been continually operating at 20% to 30% short of staff for three straight years now. In Ad-Seg I have had my 1 hour out of cell 4 times in 2 years. We have had spaghetti sauce and beans 2x per day every day for 90+ days. Commissary always has an excuse why they don’t run and library runs roughly 6x per year instead of weekly.

The wardens and majors and rank walk through and focus on taking down pictures and string lines. Micromanaging the small shit instead of handling real issues like starvation and excessive suicide. There is no medical provider on staff here so don’t run medical. No mental health. Prescriptions run out long ago and nobody to refill.

Today we are on lockdown because they can’t control contraband: this itself is an admission of failure by staff. I mean you can’t manage 20-30% staff? WTF would they do with 100% staff? Their incompetence is killing, literally killing us. As in deaths. A lot of them.

A Connally Unit prisoner wrote on 25 September 2023: I am currently G5 custody level being held at Connally Unit in Kennedy, Texas at a Texas State Prison (TDCJ). We are currently on lockdown. I believe all TDCJ is under lockdown. Apparently they are cracking down on narcotics and any other form of contraband. We have been on lockdown since Wednesday, 6 September 2023. Correction, that was an annual lockdown. We had a restriction lockdown on 24 August 2023, and we have been on lockdown ever since.

Our last commissary day, the last time we actually hit, was on August 21st. I believe we are supposed to go every 30 days or so, at least a hygiene store and we haven’t had any of that! The first restriction lockdown was placed (not formally but rumor goes) because someone snitched gave TDCJ staff heads up about some contraband and people involved. Who and what I am not sure. I am not allowed out of the cell except for showers! Up until recently they was not running showers regularly.

We received tablets (all G5 custody) on Tuesday, 19 September 2023. Since then things have gotten way better! Showers run more regularly, food comes at reasonable times. We get cold water runs! The food portions are better than before. The fires have stopped! You know, I am not sure if visitation is now open. The terrors have since stopped though! What a relief. Ok, so the terrors began on the 1st day of restriction lockdown (8/24) I couldn’t see much and didn’t know what was going on but they raided (shookdown) a couple people’s cells in 8 Building L pod 3 section. We was never informed that we was placed on restriction lockdown or why. I found out gossip from another inmate.

Since day one, no showers, no cold water runs, no heat respite, (I don’t believe G5’s get any respite) small food portions and they would run late. It is extremely hot in Connally. It is even hotter back here. Connally Unit is a down south Texas max security unit. There have been multiple times I have passed out due to the heat, woken up with major headaches, bloodshot eyes, and chapped lips!

…They shook us down on September 9th, Saturday. They didn’t finish the whole building til 15th or 16th, which is about when we got our dearly beloved SSI’s back!!! The suffering ends, partially… When they shook us down – cell search – they took the whole section out cell by cell in cuffs, and placed half the section in one side multi-purpose room and the other half in another multi-purpose room.

We came back to a Great Mess! Haha, I don’t mind the mess, I had to re-organize my belongings anyways. I wonder why they would ask us to place our things, all of our property, neatly on our own bunks, mattress like this and that, come back to our things mixed up?! Comical! One dude went hysterical, yelling at the laws and complaining about coffee spilled on all his property! Clothes, sheets, family pictures, etc. Then, here come the fires! Multiple inmates was angry, each with their own complaints. By this time the guards had given up on putting out the fires. Which is unpleasant, adding heat literally to the already hot building and smoke. Many times I had to cover up not to breath the toxic carbon monoxide! The section gets so full of smoke it’s completely black. I figured the best thing to do was place one fan by the door blowing outwards and a fan by the window blowing hot air in. I would have to place a wet towel on the door to keep smoke from coming in. Every day was something new, every day an issue appeared! Every day a fire was made, some two, some three at a time, two or three times a day… The last fire was put out by an officer, a sergeant.

What I consider to be the most important topic since my last report is death. There have been 6 deaths that I’ve seen in the last 60 days here at the Bill Clements Unit. Keep in mind, I never leave my cell so for me to see them means it took place within the 40 or so cells I can see. There were a couple more we didn’t get confirmation on whether they died or not, but I find it strange that no check of vitals or attempt at resuscitation were made.

Of the suicides/dead bodies I’ve seen “carted off” so to speak two in particular bother me. One, because I spoke to this person every day and watched as they took all his property and left him in an empty cell and actually laughed at requests for crisis or suicide prevention. He was taken out of cell with dried blood across the waist line and burnt to a crisp from the fire inside his cell. They interviewed me as part of investigation, and I tried to explain the conditions. It doesn’t give me the warm fuzzy feeling that they will improve. I’d hate to think he died for nothing. He was a good man, a father, and my friend. Now he’s dead. Would he be alive if he were not locked in isolation in Ad-Seg? Yes. Period.

The second one that bothers me is the guy behind me and over one cell who tried to cut his hand off they say. When he was cut and howled for help, they went thru a lengthy process of running a team spraying 5 cans of gas in increments and running in and whopping his ass until he bled out. I didn’t time it, but 18 minutes is what word is on the pod.

A third they say cut his own head off. I don’t know what to say about that other than they took the body out.

In addition to the suicides there are an alarming number of us cutting and self-mutilating and hurting ourselves. Some do it to purge. Some do it to get out of cell as it’s their only option to exit the cell alive, and some don’t know why.

We are/were husbands, sons, brothers, fathers, etc. who committed a crime and were sent to prison. Neglect, abuse, and further were not part of the sentence yet that is where we are. We’re fucked up back here! That’s what I’m trying to tell you. We need exposure and HELP!

The very instant you take me out of this cell and I breathe the air in the hallway or at medical, normal feelings and behavior returns. But on the wing in the cell is pain and suffering.

Note we have not had our hour out of cell or time in outside rec yards not once this year and only once in last 120 days did some of us get rec.

Food is still in my mind one of the most important issues. While over 50% of our meals are Jonny Sacks, consisting of one peanut butter and jelly accompanied by a 2" x 2" piece of food loaf. The occasions when we do get trays of cold food I still measure it and it only fills a coffee cup partly. The measuring spoons they use apparently aren’t slotted spoons so we get spoon fulls of water. Today I measured with my tablespoon: 3 tablespoons of main course gravy and what looked like cat food, 2 tablespoons of black eyed peas, 2 tablespoons of green beans and a small piece of cornbread. That’s it! Filled my coffee cup half way and didn’t begin to fill my tummy. Other than holiday trays we haven’t seen a dessert on a tray in over 8 months. This is not the diet they request funding for, nor the diet they report to our people that they clam to be feeding us yet it is what we get.

MIM(Prisons) adds: In a recent book on the history of Texas prisons, Robert T. Chase reports in the 1940s that the:

“…near ubiquity of self mutilation had”spread" across the prison system. “Many men had cut off their fingers, mutilated their feet and cut the tendons of their legs in hopes of getting shipped from this institution” [Darrington]… The prisoners claimed that they could not “stand the beatings of the guards and took this way out to keep from being killed in the fields by the guards.”"

As described this was largely in response to the brutality prisoners faced when working in the fields at that time, a practice that is no longer the norm. Today the most brutal conditions prisoners face are usually in solitary confinement. The torture has shifted from primarily physical to primarily psychological. Yet this response of self-mutilation as a way to escape continues.

Solitary confinement is a form of torture used for political repression and social control. This comrade’s report highlights the inhumanity that it brings. The deaths from suicide and beatings is only secondary to the deaths from K2 and fentanyl. We have continued to work to bring exposure to these issues while supporting those organizing against them. The campaign to shutdown the Restrictive Housing Units and all forms of long-term solitary in Texas is an ongoing and high-priority campaign. Texas holds the largest number of people in solitary of any state, and a higher percentage of its prisoners are in solitary than most.

For 2 years now they have been short of staff or so they claim. For 18 months they operated at 20% staff and for the last 6 months they claim to be at 30% staff yet I’m certain an audit of certified payroll would differ, especially salary or ranking positions.

Absolutely zero SOP (standard operating procedures) are adhered to. Each rotation and every shift on every line is a freestyle depending on how that officer chooses to conduct his/her daily routine. Count is the only exception as all are constantly counting, especially when this interferes/conflicts with prisoner movement and/or distributing meals that regularly sit out for a long time (on occasion 4+ hours till next shift has to deal with it) resulting in all meals served cold .

I spent the last 6 days under a blanket blowing my breath into the space to try and keep warm. When I say cold I mean ice with the so called temperature controlled (without any thermostat) Air conditioner blowing.

Mental Health requests, telepsyche, 2nd day mental health related issues take 9 months minimum if you ever see the telepsyche or for psych meds while the self mutilation, smoke inhalation, and suicides are at an all time high. The number of Ad-Seg prisoners going or gone crazy is astounding. No, sad actually. Disturbing when witnessed first hand but that is a problem. We are isolated from any and all civilization.

The weekly library actually drops off/ picks up books once every 6-8 weeks while we receive late notice disciplinaries for late books we cannot return if they don’t pick up.

They do not run recreation or allow us our 1 hour out of cell ever. On occasion, they will fill the 6 rec cages maybe once every 6 weeks but there are over 60 prisoners for 6 cages and when they only run 1 shut, they document they ran rec and we get fucked.

50% of all meals are Jonny Sacks. Always an excuse but never do we get the diet as budgeted or as advertised. They steal all desserts so we never get our once a week dessert. Jonny Sacks are a spoon of peanut butter in a corner of two pieces of bread and 2 boiled eggs. We do not get the drink called vitamin c drink (juice) but half the time and we never get coffee + milk with breakfast like General Population.

When it comes time to review for getting out of Ad-Seg or program eligible they write us bogus disciplinary charges and run fictitious hearings resulting in automatic guilty verdict and restrictions ineligible to get out of Ad-Seg or go to programs.

No phone calls no video visits, no tablets as advertised by TDCJ- no effort or progress related to the tablets that are stored on site . Nor do we get official word. No media access. No radio as they have faulty wiring. No local papers. No echo TDCJ papers. No clue what’s happening outside these walls just as they have no clue what’s happening inside. They report they installed televisions. They mounted two TV’s where they cannot be seen and the faulty cable wires mean no reception.

In protest fires burn daily on each of the Ad-Seg lines. Prisoners burn any and all items that will burn. So many so often they don’t even react or bother to put them out, consequently we have no mattresses. Waiting list over 18 months to get a mattress. We sleep on steel and concrete. There are no radios for sale on commissary. They send us books then collect them as contraband. No cell cleaning disinfectant or bleach.

We starve and eat crap. Spoiled rotten crap. Many actually eat their own bodily waste and drink urine. Both hungry and mentally ill. Constant screams. No crisis, suicide prevention, Chaplain, medical response etc. For those in pain there is no medical relief. Suicides happen as threats, and early warning signs are ignored. One must cut themselves badly to be removed from cell. And we all do.

No windows, fresh air or sunshine, makes for a gaseous vapor in the air that means pain. Scream all you want its music to their ears. Ad-Seg B housing for confirmed family members labeled STG (security threat group). I estimate nearly a quarter of the prisoners in Ad-Seg now have empty cells with no personal property as it is constantly taken without any due process at all. Often for standing up for one’s self or trying to protect one’s rights or get what ones entitled to result in loss of property with no formal procedure or due process. Regardless of religion or affiliation they force christian music and preaching for 10 minutes every Saturday. No other religious material is available for any religion.

No barber in Ad-Seg no haircut for over 18 months now. We either shave our heads with razors or grow long hair and beards. They put us on bogus restrictions and limit how often we can buy stamps papers pen envelopes etc to write out. Much of our outgoing and incoming mail mysteriously does not reach its intended destination. Can’t prove who is at fault.

They took away and banned any pics of women that may cause arousal. Religious medals and items have been out of stock in commissary for the last 2 years. Chaplain offers no addresses or info for any but christian. The law library here offers no help, only issues exactly what document you request if you know exactly what to request. Grievances 100% denied with responses completely bogus and irrelevant to the issue attached. Completely useless when the board works for TDCJ and they review and devise on complaints against them.

We are not receiving the items budget for and paid for with tax dollars. We do not get the beef we raise on the fields. We do not get the pork we raise. We do not get the chickens we raise. We do not get fresh vegetables from field squad. We do get eggs, where does the rest go? I’ll tell you. They sell the choice cuts of meat for money and the lesser gristle and refuse in return.

The conditions within these walls are far worse than I witnessed in military POW camps. they call for nothing less than military action to get inside and expose what is occurring and begin a healing process. Its fucked.

There hasn’t been any light bulbs for 18 months. I only recently received one light bulb. Sit in a dark cell with no light.

Roaches and mice are an infestation. ORK Pest control in Amarillo Springs regularly comes but none die. I owned a pest management company and can tell you its not copacetic.

What I’m running into is a denial of all grievances, refusing all due process rights, and one-sided administration that makes rules they hold us accountable for and completely ignore those punishing them. Lawsuits are difficult with no assistance and I’m running into a cost issue of not being able to produce documents necessary for TDCJ to prove pro se or indigent.

Shake downs every 90 days and regular cell search result in losing much of what they sell us as they just take it period and destroy our cells in disarray tearing books etc.

Of the 20 to 30% staff, many are foreign working on indentured servitude program receiving less or no wages. Purchased into slavery from an African country and housed on site and bused around. Nigerian/African prisoners, debts owed, criminals, and outcasts purchased under flag of indentured servitude.

Majority have sold out and crossed over to become a part of the problem as they were too weak or chose not to fight a battle they couldn’t win alone and divided we are. The few of us who resist are overwhelmingly outnumbered and now fight the administration less as we first have to fight the layer of those who were once us and crossed over. Fighting amongst ourselves and trying to interpret rules all by design a smokescreen to hide the underlying more predominant fights. The criminals who take us prisoner, abused and torture and neglect us, and steal all the funding allocated for the “solution to the problem” the failure of democracy, justice and Law in this entity.

I stand up for what I believe and will resist or fight ’til my last dying breath; I call for help and assistance. I Need the methods I use to help change things from what they currently are to closer to the original intent which is reform and discipline and department of “corrections” is necessary.

North Texas AIPS Adds: We assume many similar reports have been censored by the state of Texa$ through direct or indirect methods as this writer describes above in regards to materials being taken away through cell searches and terrorism from the staff. The few that do come through highlight the extensive problems regarding any accountability the guards have to the Texa$ prisoner population and continuing neglect and abuse. While reform can be a useful tool to facilitate organizing and education, the original intent versus practice for prisons in amerikkka has always been to further suppress organizing among the oppressed masses. Fighting the conditions of Ad-Seg in this state must be for the purpose of revolutionary organizing and education if your goal is to end this long list of abuses.

I would also like to bring to your attention that it took 3 days for the guards to find out that an inmate had died in A5 closed custody on the Bill Clements unit in Amarillo, TX. The cause of death is unknown to many of us inmates with this quarantine COVID-19 pandemic crisis lock down in effect. We inmates on the Bill Clements unit in Amarillo, TX would like to know if the inmate that died was because of violence or because of the Corona COVID-19 virus. Will you please investigate so us inmates on the Bill Clements unit in Amarillo, TX will have answers please.

MIM(Prisons) responds: As of 26 June 2020, the TDCJ reports at least 79 prisoner deaths and eight staff due to COVID-19. While no prisoners were reported dying from COVID-19 at Clements unit prior to 21 April 2020, the date of your letter, one staff member from Clements did die that day. Since then, a few prisoners from Clements have died as well after being sent out to hospital.

My area of concern is Prisoners’ Civil Rights. I see all types of harassment! “Under color of state law” type issues are an ongoing problem in Texas prisons. But the thing that hurts me the most is inmates losing their line-class, custody level, and parole eligibility over a disciplinary report that consists of only one or two sentences.

Officers filing such reports are to give the full details underlying the facts of the whole situation. So this lack of detail leaves the door open for the officer to say anything they want at the hearing. It’s like they just hurry up and do a rush job on writing a case, then just make up the rest when the Disciplinary Hearing Officer calls the Charging Officer.

It’s wild! 95% of what the Charging Officer says is not mentioned in the report. So much for truth, accuracy and completeness of material information, right? The omission of detail – once the officer signs and dates anything – is falsification of records. And it’s like nobody sees it or even cares. Blows my mind! And these are the people the government hires to supposedly turn us back into society as rehabilitated.

I want people in prison to know their rights and use them. My group, called “Class Act” helps prisoners who are victims of harassment and mistreatment.

Write your grievances and allow 48 hours for them to be screened. Then, send a Request to the Unit Grievance Investigator asking for the case number and the investigator’s ID number. Keep your complaint alive. Request the status of your complaint. Let them know your complaint wont be swept under the rug. And inspire others to do the same.

I’m white (lol). I need this plug of unity, I was very impressed by your newsletter. I am white, but I grew up in boys’ homes, jail and prison. So I’m looked at or I feel oppressed as a minority because I’m not down with the Supreme Race thing. I’ve never been a Gangster, but I’ve always been a thug. I’ve lived the Thug Life: sold drugs, done drugs since I was 15. I’m from the Hood.

If you can lace me up on your cause more clearly that would be cool. And I hope that my Civil Right Concern is an acceptable issue to be welcomed as a new Comrade. I’ll write more later this week. With much Love and Respect!

Recently I read one of you printouts and was very interested in getting one. I am enclosing some stamps that I hope will cover the mailing cost.

I am not sure if you can provide me with a bit of information but I am going to ask anyway…

Here on the William P. Clements Unit we NEVER have access to gym rec. ALL the gymnasiums have been taken over by staff for other uses. Building 3’s gym is for prisoner property… Building 4’s gym is for the craft shop that is NEVER open (staff shortage)… and building 8’s gym is for religious gatherings.

I don’t know if the TDCJ had a recreation policy change eliminating gym use for prisoner recreation, or if this is just something done on this unit. I am hoping you can let me know something.

Right now I am on G4/medium custody. We are only given 2 hours of day-room per day. No job assignments, other than field squad, which doesn’t exist. No educational programs. No religious services. Going to the law library is a tortuous experience because the staff member in there will do everything she can to keep a man from studying policies about TDCJ.

I don’t know if you can get the TDCJ Administrative Directive about general population recreation and let me know about the gym’s and about out-of-cell time for medium custody; but I’d be grateful if you can let me know something about this.

If this unit is in violation then I’ll be able to file the grievances, then get the courts to assist in correcting the violations.

The issue that I’m working on here at the Clements Unit is what the laws here call “time out.” By the way, I received the Texas Pack and it has been a huge help. I can’t thank you enough.

Anyways, when a law decides to harass an inmate, and gets a response he don’t like, they place you in restraints and escort you do the Administration building, and put you in a holding cell with no restroom. There ain’t no PHD(?) cells on that building. And they leave you in there for hours.

So while you’re gone, your property is just wide open for grabs. Officers hate to inventory property but they quick to lock you up. So when you file a grievance, grievance staff try to save these laws by screening the complaint, and putting the wrong grievance code. So the objective is to stop all that deliberate indifference, and stop the due process violations and make it better for the next man. And the Texas Pack is one of the tools I needed to get me started.

If officers put as much effort into inventorying your property as they do locking you up on PHD, we wouldn’t have to file property claims. But no, they use your property loss as a retaliation act.

So what I did is, on my complain (I-127), my opening statement made it clear that I was filing on the guidelines outlined under grievance code #515 (property lost/missing/stolen/damaged). Because if you don’t state the grievance code, the investigator may put a different code. Grievance codes 512 through 515 consist of issues about property here in Texas.

Also, I was going through my past complaints (I-127s) and the action you request to resolve your situation could change the grievance code number. So be careful, and make sure your resolution request runs consistent with your statement of complaint. Because if you file a harassment complaint, and you request that a case be overturned, the grievance will be graded as “improper.” “Staff harassment” is grievance code #812, but if you mention that you want the case he wrote you to be overturned, then it changes the issue. Then the complaint conflicts with the resolution, so therefore the grievance becomes “improper.”

And I’m sure that is mentioned in the grievance manual that Texas hides. So inmates become frustrated because they don’t understand and give up. Then the law wins again. Much love to MIMP and all my fellow inmates.
