Federal Prisons

I am writing from Kern Valley State Prison in Delano, California. I am writing to seek outside assistance and support on a few issues of importance and necessity for the entire population's well being. I have personally addressed these issues to Wardens, Captains. Lieutenants, Sergeants and C/Os. The two most common excuses I get are, there is not enough money in the budget or this is a new prison that is not fully up and running. How could this be?

I arrived here in February 2006, and have seen little if any improvements. I opened the 4th building on this yard out of 8 buildings. Unit recently I have been an active participant on the I.A.C. (Inmate Advisory Counsel). Working on that committee afforded me numerous opportunities to address this administration to no avail. All the necessary steps were taken to exhaust appeal procedures, the 602 process here is flawed on all levels. They have the same excuses as everyone else or constantly screen out appeals requesting unnecessary paperwork and then when provided still deny the appeal.

I am currently starting from scratch to create my own paper trail in regards to disinfectant. They simply do not distribute it to the cells. They use every possible excuse when in all reality they do not support their claims. By law and Title 15 Article 5 personal cleanliness Section 3060 means state institutions will provide the means for all prisoners to keep themselves and their living quarters clean and to practice good health habits. The Departmental Operational Manual has numerous paragraphs which concur and support this. Yet it is still not issued.

We also have no self-help groups. IAC did submit paperwork to have one approved and we never heard back. We had our dayroom taken well over a year ago with the promise that it would be returned. We did not abuse that privilege to have it taken in the first place. There is a very limited number of jobs, no NA or AA groups, no hobby craft or in cell hobby which could be consistent with a maximum security prison. A lot of prisoner parole guidelines or lifers board guidelines require them to attend such groups. Well those guidelines cannot be met when this institution does not provide the means to do so.

This is just a short list of problems here at KVSP. I am putting this out there to shine some light on the injustices of prison life. We need outside pressure put on this institution.

This brief letter is not a complaint but only to raise my voice against the injustice I'm experiencing here at the Estelle High Security Unit.

I understand the implications pursuant to Correspondence Rules BP-03.91, of which each out-going and in-coming letter to and from offenders are indeed subject to inspection and if such letter is denied then the offender and the sender will be provided a Correspondence Denial Form within seventy-two hours of rejection. This is designed to go into detail informing the offender of the appropriate cause and the evidence relied upon for this denial, and whether he intends to appeal. If he does not wish to appeal, then he has the choice either to have the letter destroyed or sent back to the sender at the offender's expense. This rule, policy or procedure is not being followed.

As stated, there is no question a uniform procedure for denying out-going and in-coming mail is needed. I don't have a problem with the policy. I have a problem with the process. The BP-03.91 policy is a complete method of procedures, which establish a way of doing things and each procedure shall be related in accordance to policy.

What the mailroom staff (Office of Intelligence) are doing is shifting/switching procedure from one day to the next to cover whatever actions they've taken. In a very plain term, its unfair and totally inappropriate to shift or switch procedures in midstream without giving prior warning to offenders. How can any offender follow rules which constantly change without any notice? Rules, policies and procedures that change without notice confuse me as well as other offenders.

This policy is vague and ambiguous, leaving major openings for misinterpretation and giving unreasonable discretionary power to unit Gang Intelligence Officers that TDCJ-ID has left largely unchecked and unquestioned and untrained in key areas of the policy which, in return, causes animosity towards myself and other offenders. They use these misinterpretations to vastly exaggerate accounts of supposed gang-related information, and to justify denial of out-going mail. When mail is denied it often takes weeks before an offender is notified or if the correspondence is not denied it is sent out weeks later. All this is under the guise of security.

If the G.I. (reader) decides my letter contains dangerous content the letter will automatically be denied. How these readers define such content, and who plays a role in making that determination are questions without clear answers. And while such denials require written notification, in practice that rarely happens.

A review of the process exposes a policy in which sections of the policy either contradict each other or are shifted from one day to the next so that no one is responsible. The mailroom, the G.I. and/or Wing officer or even other offenders have access to our mail. The policy isn't even uniformly applied. These type of standard procedures will continue to exist because the mailroom staff insists on denying out-going mail without providing a written notice and without returning back offender's stamped envelopes.

For over two years on this unit, when out-going mail was denied the offender was informed and his stamped envelopes were confiscated. Only after the mailroom staff became so sloppy that they no longer even passed out any denial forms were there enough questions raised that it was discovered that the offender was supposed to receive his stamped envelope back, how nice! However, if questioned about where the thousands of stolen or wrongly confiscated stamps when to the past two years, there is no answer. In fact, any offender ho dares to ask will be retaliated against. Even when caught, the mailroom staff will deny that their conduct was unlawful in any respect.

Enclosed in this letter are grievance step one and two proof of my effort to remedied the problem but as you can see their response is always the same "...The Estelle Unit mailroom is processing all incoming and outgoing correspondence in accordance to BP-03.91. No further action is warranted..." I have other grievances that consist of the same issues but were handled with the same answer.

The U.S. Justice Department says there are 33% of disabled people in prison. Texas closed mental health hospitals and a lot of disabled people are now housed in prison.

A disabled person makes $9,000 a year to live on the streets, but TDC makes $32,000 a year to house the same person. In TDC there is no protection for disabled people and most can’t write or think properly to protect themselves from rape, extortion, beatings and mistreatment from staff and medical care.

This is one case out of many that I am trying to bring to light. I was being overdosed at the pill window [where they dispense medicine in the prison]. The pill window staff would give me an odd number of pills repeatedly and when asked why, the reply would be “Take your meds or receive a disciplinary case.” Over the course of this three and a half years, my blood work has come back toxic three times. While this was going on I had over 30 seizures and I started having blackouts. I did not receive treatment for years.

When I first learned that I was being overdosed I told the nurse. The reply was “we don’t do that” so I wrote emergency grievances but they were all kicked out. I requested help from the doctor and he said “he’s crazy” and sent me to the mental health department. Then TDC put me to work while I was still unstable from seizures. I had three seizures at work and they said it was a security issue and put me back to work in the hot kitchen where I had 4 more seizures.

Eventually I talked to a nurse who stopped the overdose of one of my drugs. But the medical department continued to cover up the overdose while the overdose of another drug was still going on. I told the nurse manager that I needed my medical records to show the doctor to stop the seizures and blackouts. She said “we don’t keep those records” then added “some of your records are not for you to see.” Then she told me “get a lawyer.” When my lawyer finally was able to get my medical records, I found that the overdose was deleted from my records. The lawyer asked the nurse manager about this and was told this was a mistake and sent the records again. But the records were not corrected. After repeated appeals and requests for my full records, on the fifth try I got a set of records that show them overdosing me 11 times, but the rest of the dates were changed.

After 2 years I wrote to Senator John Whitmire and to the Texas Medical Board. The Senator faxed a medical release to get my medical records and within two weeks the doctor called me in and asked me what was wrong. I told him “seizures, blackouts, confusion, and I could not eat.” He asked how long and I told him I had been reporting all this for the past two years. He said he would send me to a neurologist.

Then my letter from the Texas Medical Board came and the response said “the doctor is now under investigation for what he has done and now his case is in the director of enforcement.”

My last seizure was August 2007 and I was sent to the emergency room. There I weighed 148 pounds, that is a loss of 52 pounds from this treatment. My appointment with a neurologist showed neurological problems. So I filed a case in federal court and was denied counsel. Now I must represent myself.

This is going on in prison. There was a man who died August 9, 2007 from seizures from the same treatment I was getting. If they have the ability to change my records, then they will change anyone's and get away with it.

Peep this out! You all remember sending me a document of someone saying that ROSP [Red Onion State Prison] allowed his January 2008 issue of GQ to come through when it had an article concerning the Crip gang lifestyle? Well, I went and ordered GQ in hopes that they slip up, to help in our defense in this battle. Well, in the August 2008 GQ, under the topic crime, there is an article titled "Mexico's Red Day" on pages 96,97,98,100,102 and 103. In it they talk about gang/drug cartels, rapes, small gang war, killing left & right behind the gang & drug war, cops getting killed & using their rank to get over on people.

I mean, how could these three levels of review miss this, especially when it's dealing with Mexico and they are aware of the conditions of poverty there? It's disappointing to see such blatant racism go unchecked, just because GQ is deemed a white publication while XXL and others are "Black." But it's alright because these fools insist on placing themselves in a position that they can't justify. They want a strictly enforced policy that they don't even honor.

MIM(Prisons) adds: There is an ongoing battle against censorship in Virginia, where the prisons are rejecting all MIM(Prisons) literature as well as any other publications considered "Black" like XXL. SCI Fayette has about 1800 to 2100 prisoners, of those 1200 to 1400 work for the DOC doing various work assignments. Jobs are related to running of the facility, such as maintenance, commissary, grounds crews, schooling, laundry, barber shop, library and janitors. Some also work for "Correctional Industries." The pay scale is as follows in $/hour:

People usually work from 120 to 160 hours per month, so top pay would be $50.40 to $67.20. Correctional Industries (CI) makes 51 cents or about $81.60 a month. Like similar programs that exist in all 50 states, Pennsylvania Correctional Industries produces things such as furniture, clothing and personal care products primarily for purchase by state agencies. However, on their website they claim they are unique in that they are completely self-sufficient. Like most examples of "industries" in prisons, they allow the state to save money, but there is no private profit being made.

Barack Obama's July international tour gives as much insight into what is not important to Amerika as it tells us about what is important. Looking at where Obama's tour stopped, we can see some big continents skipped: He did not visit Asia, Africa or Latin America. These regions represent the vast majority of oppressed and exploited people in the world. That's not to say Obama only focused on imperialist countries, but his visits to Iraq, Afghanistan, Jordan and Palestine underscore the relative importance of the Middle East to imperialism right now.

The missing Third World

It is pretty clear that Amerikans are not very interested in Third World countries as long as super profits flow back home and there is no perception of significant threat. The Amerikan government has done a great job of building up fear around the Middle East and its potential danger to Amerikan people. This served to justify several recent battles in the ongoing World War three against the Third World, and maintains our focus on this region.

Asia is currently in the news only for the Olympics and stories about pollution in Beijing. It is interesting that many have taken the opportunity of the Olympics to attack China and its foreign and domestic policies. We at MIM(Prisons) are not fans of the capitalist government in China, but we find their policies no more objectionable than those of the many other imperialist countries that have hosted the Olympics. And as we've discussed in a previous article on Tibet (White Nationalism still reaching out to Tibet), the attacks on China around this topic are regurgitation of white-washed imperialist history. Historical example predicts that the white nationalists condemning China will not rally for an independent New Afrika in response to Chicago's bid for the 2016 Olympics. Yet, New Afrikans were enslaved by amerika, whereas Tibetans freed themselves from slavery in joining the socialist project of the People's Republic of China in the 1950s. The current mayor of Chicago has overseen numerous slayings of Black residents and many years of torture chambers run in the city's jails, targeting New Afrikans in particular. Mayor Daley's father oversaw the murder and imprisonment of Black Panthers, Vice Lords, Black P. Stone Rangers and other organizations organizing for Black self-determination as mayor of the city in the late 1960s. China would be hard-pressed to outdo the city of Chicago alone in its genocidal national oppression.

Even his African heritage is not sufficient reason for Obama to talk about that continent, much less visit there. In general Amerika is pretty happy to ignore Africa and it is among the regions of the world that the Amerikan public knows the least about. In Zimbabwe there is significant turmoil over Presidential election results and subsequent economic collapse. Imperialist hegemony relies on relative stability of oppressed nations and so there is a lot of interest in this country right now. The U.$. has gotten involved to the extent of calling for sanctions on the Mugabe government but this country is not impacting the Amerikan economy enough to merit further action. In reality this is a good thing as attention from Amerika generally means imperialist intervention (overt or covert) and is generally devastating for a country. But the flip side of that is that countries already devastated by imperialism are ignored because of the poor conditions and lack of threat to imperialism. The U.$. is setting the stage for potential actions against the Mugabe government in the future if that seems useful to imperialism, and this is something anti-imperialists must remain vigilant about fighting.

Iraq and Afghanistan

All eyes are on Iraq as Amerikans continue to fight a war that was started under false pretenses but continues as Amerika fights for a strong foothold in the Middle East. Obama continues to advocate a pull out of troops within 16 months if he is elected President. But as we reported in a previous article on the elections: Just because he wants to pull troops out of Iraq doesn't mean Obama is anti-militarist. Obama is clear that he will use the Amerikan military to defend the Amerikan economy. From his web site: "The excellence of our military is unmatched. But as a result of a misguided war in Iraq, our forces are under pressure as never before. Obama will make the investments we need so that the finest military in the world is best-prepared to meet 21st-century threats." And he wants to expand the imperialist military: "We have learned from Iraq that our military needs more men and women in uniform to reduce the strain on our active force. Obama will increase the size of ground forces, adding 65,000 soldiers to the Army and 27,000 Marines."

Further, Obama has called for u$ troop redeployment to Afghanistan and into Pakistan. Essentially Obama will free up the resources to move from one invasion to another. Meanwhile, one of Obama's high-profile foreign policy advisors is Zbigniew Brzezinski, who's book detailing plans for continued amerikan hegemony foreshadows the current occupation of Afghanistan to secure access to the Caspian Sea. Brzezinski was a strong backer of the Shah in Iran, and later supported military occupation of the country to maintain stability after the Shah's fall. The amerikan imperialists will disagree on where to invade and who to befriend, but they never disagree on whether to be imperialists or to promote amerikan domination over the rest of the world.

There is really little difference between Obama's position and that of the current administration. Bush is now saying clearly that the "terrorists" in Iraq are on the brink of defeat and the Iraqi government and security forces are getting stronger, which would allow “further reductions in our combat forces, as conditions permit.” (NYT, Aug 1, 2008) Bush is likely looking for vindication of his policies and a "victory" before the end of his presidency, but the government also recognizes the decreasing popularity of this war with the Amerikan people. Earlier in July, Bush announced a plan to send more troops to Afghanistan: "We're going to increase troops by 2009." (Yahoo News, July 2, 2008)

Iran

This brings us to Iran - not a stop in Obama's world tour but a topic he discussed several times in public speeches around the world. "A nuclear Iran would be a game-changing situation, not just in the Middle East, but around the world," said Obama. "A nuclear Iran would pose a grave threat, and the world must prevent Iran from obtaining a nuclear weapon." "It would endanger Israel and the rest of the region, and it could embolden terrorists and spark a dangerous arm race in the Middle East."

Obama is putting forward consistent imperialist rhetoric which sets the stage for an invasion or any other attacks against Iran the imperialists deem necessary. This is partly due to the position of the close Amerikan buddy, Israel, a country that considers Iranian nuclear power to be a direct threat. It is ok for Israel, a viciously aggressive country with a bloody history of repression against Palestinians, to have nuclear weapons, but their enemies must not be allowed to develop such tools. Some have speculated that Israel may attack Iran, and if that happens Amerika wants to be positioned to support their ally.

Israel

During his stop in Israel Obama told Israeli President Shimon Peres: "I'm here on this trip to reaffirm the special relationship between Israel and the United States and my abiding commitment to Israel's security and my hope that I can serve as an effective partner, whether as a U.S. senator or as president." Obama has always been consistent in his strong support for this imperialist ally. Joining him on his tour of the region was Dennis Ross, a former Middle East envoy who is a consultant for The Washington Institute for Near East Policy, a think-tank promoting the Israeli lobby under the guise of academia.

Oil

Very related to Middle East policy, with so much attention to gas prices in Amerika, John McCain has seized on this issue as the path to the presidency and is vocally promoting offshore drilling. Of course invading oil-rich countries is one way to gain control of significant stores of oil and bring down gas prices, but since that seems to be costing more Amerikan lives and money than the Amerikan people are willing to tolerate, environmental destruction to get at more oil is a reasonable backup strategy for the imperialists.

A poll from the Public Policy Institute of California reported that by the end of July Californian's had shifted their opinions, with a slim majority now supporting offshore drilling. California would be one of the main sites where costal waters would be opened to drilling by the McCain proposal. Historically public opinion has shifted with the price of gas - as prices go up, support for drilling goes up. This is typical Amerikan me-firstism, which leaves room for environmental protection, national self-determination, and other policies that are good for the majority of the world's people only if it doesn't impact their pocketbooks.

McCain's new support for offshore drilling has certainly gained him some donations from the oil industry. But a 2007 study from the Department of Energy suggested that new offshore leases will not lead to production of oil until 2020 and would not impact prices until 2030.( http://www.eia.doe.gov/oiaf/aeo/otheranalysis/ongr.html) McCain has claimed offshore drilling could provide economic relief within months, which contradicts these studies by his own government. There is no doubt that oil drilling is bad for the environment. But the Amerikan government is uninterested in adopting far sighted policies that might protect against environmental destruction by developing energy sources. Until the Amerikan public really feels the impact of environmental destruction (in their pocketbooks or in their health) it is unlikely the government will be motivated to act.

As MIM wrote back in 1996: "The root cause of environmental problems is capitalism, the private ownership of the means of production by a relative handful of people. This essence of capitalism is one reason why capitalism creates environmental problems: while the majority of the world's people have a material interest in maintaining a healthy planet, the small capitalist ruling class is not accountable to this majority, except in the indirect sense that the ruling class seeks to co-opt the demands of the majority in order to maintain the capitalist system. A second reason why capitalism creates environmental problems is that although the world's resources are controlled by a relative handful of people, planning is not centralized under capitalism. Instead, production is anarchic; it is centered around making profits, not around meeting basic human needs in the short or long runs. Much of what is produced by the capitalist system is unnecessary and wasteful, and the system is not fundamentally capable of incorporating long-term human survival as a need. Finally, the capitalist system does not distribute resources equitably. Under capitalism, many people do not have adequate resources for survival. Many environmental problems stem from this root problem….. The capitalist system of production for profit creates a number of environmental problems which are often understood and discussed in isolation from their root causes. Key among these is pollution of air, water and land. Pollution, like all else under capitalism, is unequally distributed. European stops

Obama was received like a rock star in Berlin and was generally very popular among European leaders in his tour of that region. This just provides further evidence that Obama is a good imperialist, who works well with his imperialist allies. Being loved by other imperialist country populations may be considered good credentials by some voting Amerikans, but for anti-imperialists it is just further proof of an enemy of the people.

We have already lamented the readiness of many youth and oppressed people to join the Obama bandwagon because of his identity. Some closer to MIM(Prisons) are still suggesting that Obama represents progress for our movement and that everything reported in this article is just for show to get elected. This analysis acknowledges one important reality, while ignoring another. It recognizes that amerikans would not vote for someone who is working in the interests of the oppressed, and therefore such a persyn would have to put on a show to get elected. The mistake these people make is putting identity above a of mountain facts. We have seen serious revolutionaries degenerate into bourgeois politics, so don't think dark skin and a little time in the projects in Chicago means someone is a friend. The bourgeois theory of history upholds the idea that individuals make history, the proletarian theory looks to social forces on the group level to explain history and predict future developments. The president of the united $tates is only one persyn. Obama comes with a whole package of people, and they're all the standard imperialists, voted in by the same old amerikan oppressor nation.

More interesting than the theory that Obama is a progressive in imperialist clothing is the proposal that he could be the nail in the coffin of the Black Nation as an oppressed internal semi-colony. We would expect the bourgeois internationalists to have to pull the rest of white amerika into full integration, but we'd also expect this to require a healthy push from the oppressed themselves.

I'm an Ad-Seg prisoner here in the Texas Department of Corruptions, death valley of dry bones. I'm housed in what was originally called Super Seg due to the fact that no one ever has to leave the cell for things such as going to chow and showering. It's all done in the cell, along with the restroom. We too are deprived of virtually all human contact and mental stimuli. We are housed alone and remain in our cells 23 hours a day 3 days a week, and 24 hours a day the other 4. The only access to seeing day light is when we go to rec, because there's no windows. We have no access to educational, vocational, or other rehabilitative programs and provided with only limited access to legal material and to the general library.

This Control Unit was first called Super Seg because it was first designed to house Ad-Seg prisoners who fell under the maximum security status. There's only about 7 or 8 of these types of units in the system. After the oppressors saw how effective the controlled units were they decided to house Close Custody prisoners back here as well, since this would keep the oppressors from having to deal with the undesirable prisoners, plus it would keep them locked down. But in order to house close custody prisoners two to a cell that was designed to house segregated prisoners, they had to change the name, thus the name High Security (Expansion Cell Blocks). While the seg populations racial makeup is about 40% white, 40% Latino and 20% Black, the close custody population is about 60% Black, 30% Latino and 10% white.

I'm writing regarding the 7/24/2008 rejection notice concerning my MIM publications. The claim for such action: "Inappropriate material for the correctional environment." There was no explanation in how my publication's were classified as inappropriate. I didn't receive the notice until four day's later, 7/28/08, so that I wouldn't have an opportunity to protest and appeal the rejection of my publications.

As of this moment, I've filed my informal complaint concerning the matter. Once I've received a response, the next step is laying the foundation for 42 U.S.C § 1983. The actions of this Hitler-style concentration camp is unacceptable!

Comrade, I've been locked down in the SHU since February 24, 2008, following the first rejection of my MIM publications on false allegations of organizing a riot! The length the Amerikans will go to silence the voice of an eminent revolution is unbelievable. The time is coming, they can't stop the unstoppable comrade!

Concerning the Control Units, the designated cells are called Administrative Segregation. Depending on who the Warden, Major, and other low ranking supervisors are, all or different types of abuses take place within these housing areas. Ranging from unlawful denial of special privileges and rights, to physical abuse and food tampering. You are confined to these cells 22 or more hours a day and eat inside the cell, limited recreation, and virtually no programs for prisoners. It can be a very depressing and non-rehabilitative atmosphere. Over half of Texas Prisons house inmates in Administrative Segregation. And the mistreatment varies, so I will only speak on what unites I know of from experience.

Hughes Unit, Route 2 Box 4400, Gatesville, TX 76597. I was housed in Ad Seg from 10/2003 until 03/2008. There are approximately 500 beds in these buildings. One prisoner per cell/bed. The whole unit does not fall under the definition, only "12 Bldg" is where Ad Seg prisoners are confined, controlled and monitored daily. The racial makeup of the population is majority Hispanic, then Black, then white. Most prisoners are placed in Ad Seg for being part of a Security Threat Group, or assault towards staff and prisoners. Most situations aren't as serious as the administration makes it seem. These Control Units began opening in the late 80s and early 90s, and four of them were expanded and opened in 1999, adding 660 cells labeled as "High Security." I have no knowledge whether the state plans to open any others. Here are the addresses to the other three units that have been expanded:

Prior to being transfered from the Huges Unit in March 2008, there were several prisoners complaining about food tampering in 12 Bldg. The tampering didn't start until 2006. The substance being used attacked the immune system, causing severe headaches and drowsiness, heart trouble, high blood pressure, loss of energy, etc. I noticed the difference in my body and energy level once I got transferred and the food got out of my system.

This modern day plantation I'm in just came off a week long lockdown due to brothers acting some damn fools [Afrikan on Afrikan]. In that incident a few pigs got injured (so they say), it's funny how they claim to be injured when they was the ones swinging those sticks. In any event, the plantation was shut down then the nonsense started. Very, very small portions of food was given out, not to mention the already small portion that's given. Everyone's cell was tossed-up (they call it legal cell searches), which is crap because what does the entire population have to do with a 14 man (pigs included) incident?

During the cell toss-up these pigs just went along hand-picking brothers in their boxer shorts and handcuffed, taking advantage of them. The roughshod began and it ran for 3 and a half days of plastic buckets over the heads of brothers then striking the bucket with their sticks. They knocked the tooth out of one brother when he asked "why was they kicking his radio around."

These and many other racist tactics was done as a modern day paradigm for the Willie Lynch Theory! I say that because out of the many that I've spoken to, only a handful wrote out grievances, phoned family members, wrote lawyers, etc. The masses chose not to, in fear of retaliation! Some have open dates, others have parole boards coming up, and others just prayed for them!? That last one really got to me and it's a shame that someone would believe that the very god that they forced upon us can save us!
